19.3.1. Nhà đầu tư, Doanh nghiệp dự án được thế chấp tài sản, quyền sử dụng đất và quyền kinh doanh Công trình dự án tại Bên cho vay theo quy định của pháp luật về đất đai và pháp luật về dân sự. Thời gian thế chấp không vượt quá thời hạn Hợp đồng BOT này.
19.3.2. Thỏa thuận thế chấp tài sản, quyền kinh doanh Công trình dự án phải được lập thành văn bản ký kết giữa Bên cho vay và các bên ký kết Hợp đồng BOT này.
