Cả hai bên A và B được miễn trách nhiệm trong trường hợp bất khả kháng nằm ngoài tầm kiểm soát của cả hai bên như : thời tiết, thiên tai, bão lũ, đình công, bạo động, phá hoại, chiến tranh, dịch bệnh, các vấn đề tại địa phương, hàng không, tàu hỏa, tàu thủy hủy chuyến, trễ chuyến, đi và đến không đúng thời gian ban đầu do thời tiết hoặc do lỗi kỹ thuật, do nhà liên kết cung cấp dịch vụ, v.v…
