Trừ trường hợp bất khả kháng, nếu bên A chậm trễ trong việc bàn giao hàng hóa mà nguyên nhân hoàn toàn do bên A (kể cả do sơ suất hoặc do bất kỳ tình huống nào khác không thuộc điều khoảng bất khả kháng) thì bên A phải chịu phạt do chậm trễ trong việc giao hàng mỗi ngày là 1% trên tổng giá trị phần giao hàng chậm
