Điều 10. Điều kiện cấp thị thực

1. Có hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế.

2. Có cơ quan, tổ chức, cá nhân tại Việt Nam mời, bảo lãnh, trừ trường hợp quy định tại khoản 3 Điều 17 của Luật này.

3. Không thuộc các trường hợp chưa cho nhập cảnh quy định tại Điều 21 của Luật này.

4. Các trường hợp sau đây đề nghị cấp thị thực phải có giấy tờ chứng minh mục đích nhập cảnh:

a) Người nước ngoài vào đầu tư phải có giấy tờ chứng minh việc đầu tư tại Việt Nam theo quy định của Luật đầu tư;

b) Người nước ngoài hành nghề luật sư tại Việt Nam phải có giấy phép hành nghề theo quy định của Luật luật sư;

c) Người nước ngoài vào lao động phải có giấy phép lao động theo quy định của Bộ luật lao động;

d) Người nước ngoài vào học tập phải có văn bản tiếp nhận của nhà trường hoặc cơ sở giáo dục của Việt Nam.

Điều 11. Các trường hợp được cấp thị thực rời

1. Hộ chiếu đã hết trang cấp thị thực.

2. Hộ chiếu của nước chưa có quan hệ ngoại giao với Việt Nam.

3. Giấy tờ có giá trị đi lại quốc tế.

4. Vì lý do ngoại giao, quốc phòng, an ninh.

Điều 12. Các trường hợp được miễn thị thực

1. Theo điều ước quốc tế mà Việt Nam là thành viên.

2. Sử dụng thẻ thường trú, thẻ tạm trú theo quy định của Luật này.

3. Vào khu kinh tế cửa khẩu, đơn vị hành chính - kinh tế đặc biệt.

4. Theo quy định tại Điều 13 của Luật này.

5. Người Việt Nam định cư ở nước ngoài có hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế do cơ quan có thẩm quyền của nước ngoài cấp và người nước ngoài là vợ, chồng, con của họ; người nước ngoài là vợ, chồng, con của công dân Việt Nam được miễn thị thực theo quy định của Chính phủ.

Điều 13. Đơn phương miễn thị thực

1. Quyết định đơn phương miễn thị thực cho công dân của một nước phải có đủ các điều kiện sau đây:

a) Có quan hệ ngoại giao với Việt Nam;

b) Phù hợp với chính sách phát triển kinh tế - xã hội và đối ngoại của Việt Nam trong từng thời kỳ;

c) Không làm phương hại đến quốc phòng, an ninh và trật tự, an toàn xã hội của Việt Nam.

2. Quyết định đơn phương miễn thị thực có thời hạn không quá 05 năm và được xem xét gia hạn. Quyết định đơn phương miễn thị thực bị hủy bỏ nếu không đủ các điều kiện quy định tại khoản 1 Điều này.

3. Căn cứ quy định của Điều này, Chính phủ quyết định đơn phương miễn thị thực có thời hạn đối với từng nước.

Điều 14. Cơ quan, tổ chức, cá nhân mời, bảo lãnh người nước ngoài

1. Cơ quan, tổ chức, cá nhân mời, bảo lãnh người nước ngoài nhập cảnh Việt Nam theo quy định tại khoản 2 Điều 10 của Luật này, bao gồm:

a) Tổng Bí thư Ban Chấp hành Trung ương Đảng Cộng sản Việt Nam, Chủ tịch nước, Chủ tịch Quốc hội, Thủ tướng Chính phủ;

b) Thường trực Ban Bí thư Trung ương Đảng Cộng sản Việt Nam, Phó Chủ tịch nước, Phó Chủ tịch Quốc hội, Phó Thủ tướng Chính phủ, Chủ tịchỦy ban Trung ương Mặt trận Tổ quốc Việt Nam, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước; Bộ trưởng và tương đương; Bí thư tỉnh ủy, Bí thư thành ủy, Chủ tịch Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương;

c) Các ban, cơ quan, đơn vị trực thuộc trung ương Đảng Cộng sản Việt Nam, cơ quan của Quốc hội, cơ quan thuộc Ủy ban thường vụ Quốc hội,Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước, bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ;

d) Tỉnh ủy, thành ủy, Hội đồng nhân dân, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương;

đ) Cơ quan trung ương của tổ chức chính trị - xã hội, tổ chức xã hội, Phòng Thương mại và Công nghiệp Việt Nam;

e) Doanh nghiệp được thành lập theo pháp luật Việt Nam;

g) Cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, tổ chức liên chính phủ tại Việt Nam;

h) Văn phòng đại diện, chi nhánh của thương nhân nước ngoài; văn phòng đại diện tổ chức kinh tế, văn hóa và tổ chức chuyên môn khác của nước ngoài tại Việt Nam;

i) Tổ chức khác có tư cách pháp nhân theo quy định của pháp luật Việt Nam;

k) Công dân Việt Nam thường trú ở trong nước, người nước ngoài có thẻ thường trú hoặc thẻ tạm trú.

2. Cơ quan, tổ chức mời, bảo lãnh người nước ngoài phải phù hợp với chức năng, nhiệm vụ, quyền hạn được pháp luật quy định hoặc giấy phép hoạt động được cấp. Công dân Việt Nam thường trú ở trong nước, người nước ngoài có thẻ thường trú hoặc thẻ tạm trú được mời, bảo lãnh người nước ngoài vào Việt Nam thăm và phải có giấy tờ chứng minh quan hệ với người được mời, bảo lãnh.

Vietnam People residing abroad have passports or travel documents valid for international travel by the competent bodies of foreign countries and foreigners are spouses, their children; the alien is the spouse, son of Vietnam visa exemption for citizens as stipulated by the Government.Article 13. Unilateral visa exemption1. Decide on unilateral visa exemption for citizens of a country must have the following conditions:a) Have full diplomatic relations with Vietnam;b) in line with the policy of socio-economic development and foreign relations of Vietnam in each period;c) Without prejudice to the defence, security and social order, safety of Vietnam.2. Decide on unilateral visa exemption has a time limit of not more than 5 years and is considering renewed. The decision unilateral visa exemption is cancelled if not enough of the conditions specified in paragraph 1 of this article.3. Pursuant to the provisions of this Article, the Government decided unilaterally as long term visas for each country.Article 14. Agencies, organizations, individuals invited, guarantee foreigners1. The Agency, organization or individual offers, guarantee foreigners enter Vietnam as stipulated in item 2 article 10 of this law, including:a) General Secretary of the Central Committee of the Communist Party of Vietnam, the State President, na Chairman, Prime Minister;b) Permanent Secretariat of the Communist Party Central Vietnam, Vice President, Vice Chairman, Deputy Prime Minister, the owner of tịchỦy Central Board of Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Minister the Supreme People's Prosecutor, State Auditor General; Ministers and their equivalents; Committee, the Standing Committee, the President of the people's Council, Chairman of the provincial people's Committee, directly governed cities;c) boards, agencies, subdivisions of the Central Communist Party of Vietnam, Congress's authority, the Agency in the Standing Committee of the Congress, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuratorate, the State Auditor, ministries, ministerial-level agencies, the Agency of the Government;d) Committee, the Standing Committee, the people's Council, the provincial people's Committee, directly governed cities;DD) Organization of socio-political organizations, social organizations, chambers of Commerce and industry of Vietnam;e) enterprise established under the law of Vietnam;g) diplomatic missions, consular offices, representative offices of international organizations in the United Nations, intergovernmental organization in Vietnam;h) representative office, branch of the foreign traders; offices economic organization, cultural and professional organizations of foreign countries in Vietnam;I) other organizations having legal personality in accordance with the law of Vietnam;k) Vietnam citizens residing in the country, the alien resident card or card.2. Invites the institutions, bodies, guarantee foreigners must match the functions, duties and powers prescribed by law or the operating licence is granted. Vietnam citizens residing in the country, the alien resident card or the card is invited to guarantee foreigners to visit Vietnam and must have proof of relationship to the panelists, guarantee.

Valuable papers for international travel. 4. For reasons of diplomacy, defense and security. Article 12. The case of visa exemption 1. Under international treaties to which Vietnam is a member. 2. Use a permanent resident card, temporary residence card under the provisions of this Law. 3. At the border gate economic zones, administrative units - special economic. 4. As stipulated in Article 13 of this Law. 5. The Vietnam residing overseas passport or valuable papers for international travel by the competent authorities of foreign countries and foreign spouses, their children; foreigners are spouses or children of citizens of Vietnam visa exemption prescribed by the Government. Article 13 unilateral visa exemption 1. Decision unilateral visa exemption for citizens of a country must meet the following conditions: a) diplomatic relations with Vietnam; b) In accordance with the policy of economic development - social and foreign policy of Vietnam in each period; c) Without prejudice to the defense, security and order, social security of Vietnam. 2. Decision unilateral visa exemption period not exceeding 05 years and is considered an extension. Decision unilateral visa exemption is canceled if the conditions specified in paragraph 1 of this Article. 3. Pursuant to the provisions of this Article, the Government decided unilaterally a term visa exemption for each country. Article 14 agencies, organizations and individuals that invite or guarantee the foreign one. Agencies, organizations and individuals that invite or guarantee foreigners entering Vietnam as stipulated in Clause 2, Article 10 of this Law, including: a) The General Secretary of the Communist Party of Vietnam, President, Chairman of the National Assembly, the Prime Minister; b) Permanent Secretariat of the Communist Party of Vietnam, Vice President, Vice-President of the National Assembly, Deputy Prime Minister, Chairman of Central Board tichUy Central Vietnam Fatherland Front, Chief Justice of the Supreme People's Court, Head of the Supreme People's Procuratorate, the State Auditor General; Ministers and their equivalents; Secretary of the Party Committee, Party Secretary, Chairman of the People's Council, Chairman of the People's Committees of provinces and cities under central authority; c) committees, agencies, units of the Communist Party of Vietnam Central South, congressional offices, offices of the National Assembly Standing Committee, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, Supreme People's Procuratorate, the State Auditor, the level agencies, the agencies attached to the Government; d) Provincial Party Committees, People's Councils, People's Committees of provinces and cities under central authority; e) Central Authority of political organization - society, social organizations, Chambers of Commerce and Industry of Vietnam; e) enterprise established under the laws of Vietnam; g) diplomatic missions, consular offices, representative offices held International under the United Nations, intergovernmental organizations in Vietnam; h) the representative office, branch of foreign traders; offices held economic, cultural and other professional organizations of foreigners in Vietnam; i) Other organizations have legal status in accordance with the law of Vietnam; k) Citizens often Vietnam residing in the country, alien resident card or temporary residence card. 2. Agencies and organizations invited, guarantee foreigners to fit functions, duties and powers prescribed by law or operating license is granted. Vietnam citizens residing in the country, foreigners with permanent residence card or temporary residence cards are invited, guarantee foreigners visiting Vietnam and must have proof of ties with the invitees or guarantee.
