Không phải như ở Việt Nam, nghề luật đòi hỏi phải có bằng cấp, tức là bạn phải tốt nghiệp đại học. Cụ thể hơn, các trường đại học Mỹ không cấp bằng Cử nhân Luật. Các trường luật danh tiếng hằng năm nhận rất nhiều hồ sơ của các ứng viên đã là Tiến sĩ ở một ngành nào đấy và muốn đổi nghề làm luật sư. Hội đồng xét tuyển sẽ căn cứ vào điểm số (điểm trung bình toàn khoá học, điểm của từng môn học) mà bạn đã từng học, thư giới thiệu, bài viết giới thiệu bản thân,… và một kì thi tuyển đầu vào (tuỳ từng trường). Mặc dù điểm số bài thi đầu vào không phải là thước đo hoàn toàn chính xác khả năng lý luận cần thiết của một luật sư nhưng các trường thường đặt trọng số tương đối lớn đối với bài thi này.
