LUẬT
NHẬP CẢNH, XUẤT CẢNH, QUÁ CẢNH, CƯ TRÚ CỦA NGƯỜI NƯỚC NGOÀI TẠI VIỆT NAM
Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;
Quốc hội ban hành Luật nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
Chương I
NHỮNG QUY ĐỊNH CHUNG
Điều 1. Phạm vi điều chỉnh
Luật này quy định nguyên tắc, điều kiện, trình tự, thủ tục, quyền và nghĩa vụ của người nước ngoài nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam; quyền và trách nhiệm của cơ quan quản lý nhà nước Việt Nam, của cơ quan, tổ chức, cá nhân trong hoạt động nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
Điều 2. Đối tượng áp dụng
Luật này áp dụng đối với người nước ngoài nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam, cơ quan quản lý nhà nước Việt Nam, cơ quan, tổ chức, cá nhân Việt Nam và nước ngoài có liên quan.
Điều 3. Giải thích từ ngữ
Trong Luật này, những từ ngữ dưới đây được hiểu như sau:
1. Người nước ngoài là người mang giấy tờ xác định quốc tịch nước ngoài và người không quốc tịch nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam.
2. Giấy tờ xác định quốc tịch nước ngoài là loại giấy tờ do cơ quan có thẩm quyền của nước ngoài hoặc Liên hợp quốc cấp, gồm hộ chiếu hoặc giấy tờ có giá trị thay hộ chiếu (sau đây gọi chung là hộ chiếu).
3. Giấy tờ có giá trị đi lại quốc tế là loại giấy tờ do cơ quan có thẩm quyền của một nước cấp cho người không quốc tịch đang cư trú tại nước đó và được cơ quan có thẩm quyền của Việt Nam chấp thuận.
4. Nhập cảnh là việc người nước ngoài vào lãnh thổ Việt Nam qua cửa khẩu của Việt Nam.
5. Quá cảnh là việc người nước ngoài đi qua hoặc lưu lại khu vực quá cảnh tại cửa khẩu quốc tế của Việt Nam để đi nước thứ ba.
6. Xuất cảnh là việc người nước ngoài ra khỏi lãnh thổ Việt Nam qua cửa khẩu của Việt Nam.
7. Tạm hoãn xuất cảnh là việc người có thẩm quyền của Việt Nam quyết định tạm dừng xuất cảnh có thời hạn đối với người nước ngoài đang cư trú tại Việt Nam.
8. Buộc xuất cảnh là việc người có thẩm quyền của Việt Nam quyết định người nước ngoài phải rời khỏi lãnh thổ Việt Nam qua cửa khẩu của Việt Nam.
9. Cư trú là việc người nước ngoài thường trú hoặc tạm trú tại Việt Nam.
10. Cửa khẩu là nơi người nước ngoài được phép nhập cảnh, xuất cảnh, quá cảnh.
11. Thị thực là loại giấy tờ do cơ quan có thẩm quyền của Việt Nam cấp, cho phép người nước ngoài nhập cảnh Việt Nam.
12. Chứng nhận tạm trú là việc cơ quan có thẩm quyền của Việt Nam xác định thời hạn người nước ngoài được phép tạm trú tại Việt Nam.
13. Thẻ tạm trú là loại giấy tờ do cơ quan quản lý xuất nhập cảnh hoặc cơ quan có thẩm quyền của Bộ Ngoại giao cấp cho người nước ngoài được phép cư trú có thời hạn tại Việt Nam và có giá trị thay thị thực.
14. Thẻ thường trú là loại giấy tờ do cơ quan quản lý xuất nhập cảnh cấp cho người nước ngoài được phép cư trú không thời hạn tại Việt Nam và có giá trị thay thị thực.
15. Cơ quan quản lý xuất nhập cảnh là cơ quan chuyên trách thuộc Bộ Công an làm nhiệm vụ quản lý nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
16. Đơn vị kiểm soát xuất nhập cảnh là đơn vị chuyên trách làm nhiệm vụ kiểm soát nhập cảnh, xuất cảnh, quá cảnh của người nước ngoài tại cửa khẩu.
17. Cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài gồm cơ quan đại diện hoặc cơ quan khác của Việt Nam ở nước ngoài được ủy quyền thực hiện chức năng lãnh sự.
Điều 4. Nguyên tắc nhập cảnh, xuất cảnh, quá cảnh, cư trú
1. Tuân thủ quy định của Luật này, các quy định khác của pháp luật Việt Nam có liên quan hoặc điều ước quốc tế mà Việt Nam là thành viên.
2. Tôn trọng độc lập, chủ quyền, thống nhất và toàn vẹn lãnh thổ, bảo đảm an ninh quốc gia và trật tự, an toàn xã hội, bình đẳng trong quan hệ quốc tế.
3. Bảo đảm công khai, minh bạch, thuận lợi cho người nước ngoài; chặt chẽ, thống nhất trong quản lý hoạt động nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
4. Người nước ngoài có nhiều hộ chiếu chỉ được sử dụng một hộ chiếu để nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam.
Điều 5. Các hành vi bị nghiêm cấm
1. Cản trở người nước ngoài và cơ quan, tổ chức, cá nhân có liên quan thực hiện quyền, nghĩa vụ, trách nhiệm theo quy định của pháp luật về nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
2. Đặt ra thủ tục, giấy tờ, các khoản thu trái với quy định của Luật này và các quy định khác của pháp luật có liên quan; sách nhiễu, gây phiền hà trong việc làm thủ tục nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
3. Nhập cảnh, xuất cảnh, quá cảnh, cư trú trái phép tại Việt Nam; làm giả, sử dụng giấy tờ giả để nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam.
4. Cung cấp thông tin, tài liệu sai sự thật để được nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam.
5. Lợi dụng việc nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam để chống lại nhà nước Cộng hòa xã hội chủ nghĩa Việt Nam; xâm hại quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân.
6. Mua, bán, thuê, cho thuê, mượn, cho mượn, tẩy, xóa, sửa chữa nội dung giấy tờ có giá trị nhập cảnh, xuất cảnh, cư trú để người nước ngoài nhập cảnh, xuất cảnh, quá cảnh, cư trú tại Việt Nam.
Điều 6. Thu hồi, hủy bỏ giấy tờ có giá trị nhập cảnh, xuất cảnh, cư trú do cơ quan có thẩm quyền của Việt Nam cấp
Người nước ngoài có hành vi vi phạm quy định tại các khoản 3, 4, 5 và 6 Điều 5; khoản 3 Điều 21; điểm b khoản 2 Điều 44 của Luật này thì bị thu hồi, hủy bỏ giấy tờ có giá trị nhập cảnh, xuất cảnh, cư trú tại Việt Nam.
Chương II
THỊ THỰC
Điều 7. Giá trị sử dụng và hình thức của thị thực
1. Thị thực có giá trị một lần hoặc nhiều lần và không được chuyển đổi mục đích.
2. Thị thực được cấp riêng cho từng người, trừ trường hợp trẻ em dưới 14 tuổi được cấp chung hộ chiếu với cha hoặc mẹ hoặc người giám hộ.
3. Thị thực được cấp vào hộ chiếu hoặc cấp rời.
Điều 8. Ký hiệu thị thực
1. NG1 - Cấp cho thành viên đoàn khách mời của Tổng Bí thư Ban Chấp hành Trung ương Đảng Cộng sản Việt Nam, Chủ tịch nước, Chủ tịch Quốc hội, Thủ tướng Chính phủ.
2. NG2 - Cấp cho thành viên đoàn khách mời của Thường trực Ban Bí thư Trung ương Đảng Cộng sản Việt Nam, Phó Chủ tịch nước, Phó Chủ tịch Quốc hội, Phó Thủ tướng Chính phủ, Chủ tịch Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước; thành viên đoàn khách mời cùng cấp của Bộ trưởng và tương đương, Bí thư tỉnh ủy, Bí thư thành ủy, Chủ tịch Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương.
3. NG3 - Cấp cho thành viên cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, cơ quan đại diện tổ chức liên chính phủ và vợ, chồng, con dưới 18 tuổi, người giúp việc cùng đi theo nhiệm kỳ.
4. NG4 - Cấp cho người vào làm việc với cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, cơ quan đại diện tổ chức liên chính phủ; người vào thăm thành viên cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, cơ quan đại diện tổ chức liên chính phủ.
5. LV1 - Cấp cho người vào làm việc với các ban, cơ quan, đơn vị trực thuộc trung ương Đảng Cộng sản Việt Nam; Quốc hội, Chính phủ, Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước, các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ; tỉnh ủy, thành ủy, Hội đồng nhân dân, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương.
6. LV2 - Cấp cho người vào làm việc với các tổ chức chính trị - xã hội, tổ chức xã hội, Phòng Thương mại và Công nghiệp Việt Nam.
7. ĐT - Cấp cho nhà đầu tư nước ngoài tại Việt Nam và luật sư nước ngoài hành nghề tại Việt Nam.
8. DN - Cấp cho người vào làm việc với doanh nghiệp tại Việt Nam.
9. NN1 - Cấp cho người là Trưởng văn phòng đại diện, dự án của tổ chức quốc tế, tổ chức phi chính phủ nước ngoài tại Việt Nam.
10. NN2 - Cấp cho người đứng đầu văn phòng đại diện, chi nhánh của thương nhân nước ngoài, văn phòng đại diện tổ chức kinh tế, văn hóa, tổ chức chuyên môn khác của nước ngoài tại Việt Nam.
11. NN3 - Cấp cho người vào làm việc với tổ chức phi chính phủ nước ngoài, văn phòng đại diện, chi nhánh của thương nhân nước ngoài, văn phòng đại diện tổ chức kinh tế, văn hóa và tổ chức chuyên môn khác của nước ngoài tại Việt Nam.
12. DH - Cấp cho người vào thực tập, học tập.
13. HN - Cấp cho người vào dự hội nghị, hội thảo.

Number: 47/2014 / QH13 Hanoi, 06 May 16 2014 LAW ON ENTRY, EXIT, TRANSIT AND RESIDENCE OF FOREIGNERS IN VIETNAM Pursuant to the Constitution of the Socialist Republic of Vietnam, Congress enacted the Law on entry and exit, transit and residence of foreigners in Vietnam. Chapter I General Provisions Article 1. Scope This Law regulates the principles, conditions, order, procedures, rights and obligations of foreigners entry, exit, transit and residence in Vietnam; rights and responsibilities of state management agencies in Vietnam, the agencies, organizations and individuals active in the entry, exit, transit and residence of foreigners in Vietnam. Article 2.- application of this Law shall apply to foreigners who enter, exit, transit and residence in Vietnam, state management agencies in Vietnam, agencies, organizations and individuals in Vietnam and abroad in connection concerned. Article 3. Definitions In this Law, the following terms are construed as follows: 1. Foreigners who carry papers identifying foreign nationals and stateless persons for entry, exit, transit and residence in Vietnam. 2. Papers identified foreign nationality are papers by the competent authorities of foreign or UN level, including passport or other valid papers passport (hereinafter referred to as passport). 3 . Valuable papers international travel documents issued by the competent authority of a country for stateless persons residing in a foreign country and the competent authorities of Vietnam approved. 4. Immigration is the alien into the territory of Vietnam via border gates of Vietnam. 5. Transit means the foreigners passing through or stay in the transit area of international border gates of Vietnam to go to third countries. 6. Exit is the foreigners out of Vietnam's territory through the border gate of Vietnam. 7. Exit suspension is the authorized person of Vietnam's decision to suspend a term exit for foreigners residing in Vietnam. 8. Forced exit is the competent person of Vietnam decided to leave alien territory of Vietnam through border gates of Vietnam. 9. Residence means foreigners permanently or temporarily residing in Vietnam. 10. Gate where foreigners are allowed to enter, exit or transit. 11. Visas are papers granted by competent authorities of Vietnam allows foreigners to enter Vietnam. 12. Temporary residence certificate is the competent agencies of Vietnam determined period allowed foreigners staying in Vietnam. 13. Temporary residence cards are papers by authorities or immigration authorities authorized the Foreign Ministry issued to foreigners who are permitted to reside with a term in Vietnam and other valid visas. 14. Permanent residence cards are papers by authorities granting immigration for foreigners allowed to reside indefinitely in Vietnam and other valid visas. 15. Agency's Immigration management agency under the Ministry of Public Security in charge of managing the entry, exit, transit and residence of foreigners in Vietnam. 16. Control unit Immigration is specialized units in charge of control of entry, exit and transit of foreigners at the border. 17. Competent agencies of Vietnam visa abroad include missions or other agencies of Vietnam in foreign countries are authorized to perform consular functions. Article 4. Principles of entry, exit, transit and residence 1. Comply with the provisions of this Act, other regulations of Vietnam law related or international treaties to which Vietnam is a member. 2. Respect for independence, sovereignty, unity and territorial integrity, national security and order, social safety and equality in international relations. 3. Ensure publicity, transparency and convenience for foreigners; tight, unified operational management and entry, exit, transit and residence of foreigners in Vietnam. 4. Foreigners have multiple passports only used one passport to entry, exit, transit and residence in Vietnam. Article 5. Prohibited acts 1. Obstructing foreigners and agencies, organizations and individuals concerned about the rights and obligations and responsibilities under the law on entry, exit, transit and residence of foreigners in Vietnam South. 2. Set out the procedures, paperwork, receipts contrary to the provisions of this Law and other provisions of the relevant law; harass or cause troubles in employment procedures for entry, exit, transit and residence of foreigners in Vietnam. 3. Entry, exit, transit or reside illegally in Vietnam; forgery, use of forged documents to enter, exit, transit and residence in Vietnam. 4. Provide information and documents to be false entry, exit, transit and residence in Vietnam. 5. Taking advantage of the entry, exit, transit and residence in Vietnam against the Republic of socialist Vietnam; harm the legitimate rights and interests of agencies, organizations and individuals. 6. Buy, sell, rent, lease, lend, lend, eraser, delete, modify the contents of papers valid for entry, exit and residence for foreigners to enter, exit, transit and residence in Vietnam. Chapter II VISAS Article 7. The value of use and form of visa 1. The visa is valid for one or more times and not converted purpose. 2. Visas are granted for each person, except for children under 14 years old by same passport with parent or guardian. 3. Visas are granted to the passport or issued separately. Article 8. Symbols visas 1. NG1 - issued to members of delegations invited General Secretary of the Communist Party of Vietnam, President, Chairman of the National Assembly, the Prime Minister. 2.
