Căn cứ vào Bộ Luật dân sự hiện hành số 33/2005/QH11 ngày 14/06/2005 có hiệulực ngày 01/01/2006 và Bộ Luật Thương mại số 36/2005/QH11 ngày 14/06/2005 có hiệulực từ ngày 01/01/2006 của Quốc hội nước Cộng hòa Xã hội Chủ nghĩa Việt Nam.Căn cứ vào nhu cầu và khả năng đáp ứng của các bên .

Điều 2 : TRÁCH NHIỆM MỖI BÊN
.2.1 Trách nhiệm bên A :- Đảm bảo tư cách tổ chức biểu diễn phù hợp với quy định và giấy phép của các cơ quan chức năng quản lý ban hành và cấp phép.
- Đảm bảo hệ thống âm thanh, ánh sáng , sân khấu chuyên nghiệp
.- Cung cấp thông tin chương trình .
- Đảm bảo an ninh trật tự trong khu vực tổ chức.
- Thanh toán đầy đủ chi phí theo như thỏa thuận (điều 1)
.2.2 Trách nhiệm bên B :
- Cung cấp cho bên A danh sách các tiết mục tham gia chương trình.
- Bên B phải tới trước giờ biểu diễn trước 20:00, tập duyệt theo đúng kế hoạch của chươngtrình.
- Biểu diễn đúng với nội dung chương trình đã được bên A thỏa thuận và duyệt.
- Trang điểm và trang phục phù hợp với quy định về văn hóa trong hoạt động nghệ thuậtbiểu diễn.
Điều 3 : PHƯƠNG THỨC THANH TOÁN (Tiền mặt)
- Bên A sẽ thanh toán cho bên B số tiền sau khi ký kết hợp đồng số tiền là:………………… Bằng chữ ……………………………….
- Số tiền còn lại là ………….. bên A sẽ thanh tóan cho bên B chậm nhất 3 ngày sau khi kết thúc chương trình .
Điều 4: ĐIỀU KHOẢN CHUNG
.4.1 Đối với bên A :
- Nếu bên A thông báo hủy hợp đồng sẽ phải bồi thường cho bên B như sau :
+ Trước 03 ngày : bồi thường 50% giá trị hợp đồng .
+ Trước 01 ngày : bồi thường 70% giá trị hợp đồng .
+ Trước giờ khai mạc chương trình sẽ phải bồi thường 200% giá trị hợp đồng này.
- Bên A có quyền đòi bên B bồi thường nếu bên B biểu diễn các tiết mục không đúng với thỏa thuận, không phù hợp với quy định về văn hóa biểu diễn nghệ thuật hoặc bên B làm chậm tiến trình chương trình dẫn đến chương trình bị gián đoạn hoặc phải kết thúc sớm hơn kế hoạch kịch bản. Mức bồi thường sẽ dao động từ 30% đến 100% và sự thương lượng giữa hai bên dựa vào những thiệt hại xảy ra.
4.2 Đối với bên B :- Nếu bên B đến muộn từ 10 phút đến 20phút so với giờ đã thỏa thuận (không có lý do chính đáng) sẽ phải bồi thường 20% giá trị hợp đồng này.
- Nêú bên B đến muộn từ 20 phút đến 60 phút so với giờ đã thỏa thuận ( không có lý do chính đáng) sẽ phải bồi thường 50% giá trị hợp đồng này.
- Nếu bên B đến muộn sau 60phút so với giờ đã thỏa thuận ( không có lý do chính đáng) và đơn phương hủy bỏ hợp đồng này mà không có sự chấp thuận của bên A thì phải bồi thường 100% giá trị hợp đồng này.
- Nếu bên B thông báo hủy hợp đồng sẽ phải thanh toán lại cho bên A số tiền đãnhận lần 1 (nếu có) và bồi thường cho bên A như sau :
+ Trước 03 ngày : bồi thường 100% giá trị hợp đồng .
+ Trước 01ngày : bồi thường 200% giá trị hợp đồng .
+ Trước giờ khai mạc chương trình sẽ phải bồi thường 400% giá trị hợp đồng này.
4.3 Thỏa thuận chung :
- Hai bên cần chủ động thông báo cho nhau tiến độ thực hiện hợp đồng, nếu có vấn đề phát sinh hai bên phải kịp thời thông báo cho nhau biết và bàn bạc tích cực giải quyết trên cơ sở thương lượng. Trường hợp có tranh chấp không tự giải quyết được thi hai bên sẽ khiếu nại tới Tòa án kinh tế TP.Hồ Chí Minh và quyết định của Tòa án là phán quyết cuối cùng.Các chi phí về thẩm định, kiểm tra, xác minh và lệ phí do bên có lỗi chịu.Điều 5 : THỜI HẠN CÓ HIỆU LỰC CỦA HỢP ĐỒNG :Hợp đồng này có hiệu lực tới ngày kết thúc buổi biểu diễn và bên A thanh toán hết tiền cho bên B.Hai bên có trách nhiệm thực hiện hợp đồng này ngay sau khi đã ký kết.Tp.
