Article 29. Violation of regulations on protection of the marine environment
1. A fine of from 10,000,000 to 20,000,000 for all means of transportation, warehouse storage of goods at sea are likely to cause environmental incidents without notifying the rescue forces, national rescue Sale, Coast Guard forces, organizations and individuals concerned as prescribed.
2. A fine of between 50,000,000 and 80,000,000 shall be imposed on organizations and individuals working in the mining, the transport gas, oil, chemical, radioactive and other hazardous substances on the sea planning, human resources and equipment to ensure prevention of and response to environmental incidents.
3. A fine of between VND 80,000,000 and 150,000,000 shall be imposed for any of the following acts:
a) activity of mining resources, marine resources and other activities related to the exploitation and use of marine resources improperly planned use of natural resources has been approved;
b) Active in the nature reserve, mangrove forests, marine natural heritage is not subject to regulation of the management, regulation the law on environmental protection and other provisions of relevant laws;
c) no treatment to meet environmental and technical regulations for waste and other polluting factors from production activities, business, service, construction, transportation, transport, maritime operators;
d) order, store and transport means, warehouses, works offshore petroleum extraction process time to process;
e) Do not collect, store and handle hazardous waste regulations for exploration and exploitation of marine resources, demolition of marine transport means.
4. A fine of between VND 150,000,000 and 250,000,000 shall be imposed for the waste dumped into the sea of the common means of transportation, drilling rigs operating on the sea without treatment prescribed or not treated up technical regulations on waste; solid waste dumped into the sea from the land without the written approval of the State management agency on environmental protection as prescribed; waste disposal from dredging operations, creeks into the sea without the written approval of the State management agency on environmental protection according to regulations.
5. A fine of between VND 250,000,000 and 500,000,000 shall be imposed for the waste dumped into the sea areas under the nature reserve, natural heritage, areas with new natural ecosystems, often breeding grounds occasional or seasonal species of seafood.
6. A fine from 500,000,000 to 1,000,000,000 VND for acts dump hazardous waste, waste containing radioactive substances into the waters of the Socialist Republic of Vietnam.
7. Forms of additional sanction:
Confiscating material evidences and means of administrative violations for cases of violation specified in Clauses 4, 5 and 6 of this Article.
8. Remedial measures:
a) Compulsory, paid for expertise, measurement and analysis of environmental samples in the event of violations of waste discharge exceeds environmental technical regulations or environmental pollutants according to the norms, the current unit price for violating the provisions of this Article;
b) Forced to implement measures to overcome environmental pollution within authorized by the sanction set out in the decision provisions of administrative sanctions for violations prescribed in this Article
