ĐĐIỀU 9: BẢO VỆ MÔI TRƯỜNG VÀ NGĂN CHẶN HẬU QUẢ CÓ HẠI
Bên giao cam kết thông báo đầy đủ và rõ ràng cho Bên nhận tất cả những thông tin mà Bên giao biết về hậu quả đối với môi trường, môi sinh và người lao động do việc sử dụng công nghệ, ngoài ra khi có bất kỳ thông tin mới nào về môi trường hoặc hậu quả có hại thì Bên giao ngay lập tức thông báo, đầy đủ, rõ ràng cho Bên nhận.
Bên giao cam kết công nghệ được chuyển giao phù hợp với việc sản xuất các sản phẩm đạt chỉ tiêu về môi trường và an toàn lao động theo các văn bản pháp luật hiện hành của chính phủ Việt nam. Nếu việc sản xuất các sản phẩm của Bên nhận theo đúng công nghệ của Bên giao bị cơ quan Nhà nước có thẩm quyền phán quyết là có gây tác hại đến môi trường và vì thế mà Bên nhận phải chịu thiệt hại thì Bên giao sẽ;
- Ngay lập tức tiến hành tìm hiểu và khắc phục các sai sót của công nghệ được chuyển giao và thông báo cho Bên nhận về những sai sót cũng như chỉ dẫn cho Bên nhận khắc phục những sai sót đó.
- Chịu trách nhiệm về việc bồi hoàn cho Bên nhận đối với các khoản thiệt hại trực tiếp và các thiệt hại khác do Bên nhận phải trả do sự việc đó.
Bên giao cam kết thông báo cho Bên nhận biết đầy đủ và rõ ràng tất cả các thông tin mà Bên giao biết về việc ngăn cấm hay hạn chế việc sản xuất các sản phẩm theo công nghệ ở bất cứ nước nào hay bất cứ thời điểm nào.
