ĐIỀU 9: TRƯỜNG HỢP BẤT KHẢ KHÁNG.
- Sự kiện bất khả kháng là sự kiện xảy ra mang tính khách quan và nằm ngoài tầm kiểm soát của các Bên như động đất, bão, lũ, lụt, lốc, sóng thần, lở đất; hoả hoạn; chiến tranh hoặc có nguy cơ xảy ra chiến tranh, ... và các thảm hoạ khác chưa lường hết được, sự thay đổi chính sách hoặc ngăn cấm của cơ quan có thẩm quyền của Việt Nam…
- Việc một Bên không hoàn thành nghĩa vụ của mình do sự kiện bất khả kháng sẽ không phải là cơ sở để Bên kia chấm dứt hợp đồng. Tuy nhiên Bên bị ảnh hưởng bởi sự kiện bất khả kháng có nghĩa vụ phải:
• Tiến hành các biện pháp ngăn ngừa hợp lý và các biện pháp thay thế cần thiết để hạn chế tối đa ảnh hưởng do sự kiện bất khả kháng gây ra
• Thông báo ngay cho Bên kia về sự kiện bất khả kháng xảy ra trong vòng 7 ngày ngay sau khi xảy ra sự kiện bất khả kháng
- Trong trường hợp xảy ra sự kiện bất khả kháng, thời gian thực hiện hợp đồng sẽ được kéo dài bằng thời gian diễn ra sự kiện bất khả kháng mà Bên bị ảnh hưởng không thể thực hiện các nghĩa vụ theo hợp đồng của mình

Article 9: FORCE MAJEURE CASES.-Unforeseen events are events that happen brings objectivity and is beyond the control of the parties as an earthquake, hurricane, flood, Tornado, flood, tsunami, landslides; the fires; war or danger of war, ... and other disasters haven't anticipated the end, policy change or prohibit the competent authorities of Vietnam ... -The one side does not fulfill its obligations due to force majeure events shall not be the basis for the other party to terminate the contract. However the party affected by force majeure events are supposed to:• Conduct measures to prevent rational and necessary alternative measures to minimize the influence due to unforeseen events causing• Immediately notify the other party about unforeseen events occurring within 7 days right after the event-In case of unforeseen events, the duration of the contract will be extended by the duration of the event to which the affected Parties are not able to perform the obligations under her contract

ARTICLE 9: FORCE MAJEURE EVENT.
- The force majeure event occurs objectively and are beyond the control of the parties such as earthquakes, hurricanes, floods, tornados, tsunamis, landslides ; fire; war or risk of war, ... and other unexpected disasters is, a change of policy or prohibit the competent authorities of Vietnam ...
- If one party does not fulfill their obligations due to force majeure event will not be the basis for the other party to terminate the contract. But party affected by the force majeure is obligated to:
• Implement reasonable precautions and alternatives needed to minimize the impact of unforeseen events cause
• promptly notify the other of the force majeure event occurs within 7 days after the occurrence of unforeseen events
- in the event of a force majeure event, the time to perform the contract will be pulled long as the time of the event of force majeure which affected Party can not perform its obligations under its contract
