Điều 7. Việc định kỳ khám sức khoẻ, huấn luyện về an toàn lao động, vệ sinh lao động theo Điều 102 của Bộ luật Lao động quy định như sau:

1. Phải khám sức khoẻ cho người lao động, kể cả người học nghề, tập nghề,ít nhất một lần trong một năm, đối với người làm công việc nặng nhọc, độc hại hại thì ít nhất 6 tháng 1 lần.

Việc khám sức khoẻ phải do các đơn vị y tế Nhà nước thực hiện.

2. Trước khi nhận việc, người lao động, kể cả người học nghề, tập nghề, phải được hướng dẫn, huấn luyện về an toàn lao động, vệ sinh lao động.

Sau đó căn cứ vào công việc của từng người đảm nhiệm mà huấn luyện, hướng dẫn các biện pháp đảm bảo an toàn, vệ sinh phù hợp và phải được kiểm tra thực hành chặt chẽ.

Nghiêm cấm việc sử dụng người lao động chưa được huấn luyện và chưa được cấp thẻ an toàn làm công việc có yêu cầu nghiêm ngặt về an toàn lao động, vệ sinh lao động.

Việc tổ chức huấn luyện, mở lớp huấn luyện phải theo sự hướng dẫn của Bộ Lao động - Thương binh và Xã hội.
