Thứ ba, việc quy định bên được thi hành chỉ được nộp đơn yêu cầu khi bên phải thi hành là cơ quan, tổ chức có trụ sở chính tại Việt Nam vào thời điểm nộp đơn là không hợp lý đối với việc yêu cầu thi hành những bản án, quyết định dân sự của Tòa án nước ngoài có liên quan hoạt động của chi nhánh, văn phòng đại diện tại Việt Nam. Quy định của pháp luật Việt Nam cần được điều chỉnh theo hướng nếu bản án, quyết định của Tòa án nước ngoài liên quan đến hoạt động của chi nhánh, văn phòng đại diện của cơ quan, tổ chức nước ngoài tại Việt Nam thì bên được thi hành vẫn có quyền nộp đơn yêu cầu thi hành dù cơ quan, tổ chức nước ngoài đó không có trụ sở chính tại Việt Nam.
