Thưa Ông,
Tham chiếu thư Tư vấn LPk8CHD-16-019 ngày 18/01/2016 về việc Phụ lục hợp đồng cho gia hạn thời gian hoàn thành gói 8.
Tham chiếu văn bản số 9786/ SGTVT-XD về việc phối hợp thực hiện phạm vi trùng lắp khối lượng dự án xây dựng đường cao tốc Tp HCM – LT – DG và dự án xây dựng hệ thống thoát nước đường Đỗ Xuân Hợp. Sau khi thi công hoàn thành tuyến cống thoát nước, thì phần kết cấu mặt đường Đỗ Xuân Hợp do Ban QLDA cải tạo kênh Ba Bò thi công theo cao độ thiết kế của dự án đường cao tốc Tp HCM – LT – DG.
Nhà thầu Gói 8 đã hoàn thành nhánh X, Y trước ngày 26/2/2015, nhưng không thể bàn giao đưa vào khai thác được vì dự án tuyến cống thoát nước đường Đỗ Xuân Hợp chưa thi công xong, nên xe không thể lên, xuống nhánh X, Y được.(Đính kèm BBNT)
Sau khi dự án “xây dựng hệ thống thoát nước đường Đỗ Xuân Hợp” hoàn thành tuyến cống và mặt đường, đảm bảo xe lưu thông lên, xuống nhánh X, Y. Ngày 13/7/2015 BQL dự án HCM – LT – DG mời bàn giao đưa vào khai thác nhánh X, Y từ ngày 14/7/2015(Thư 474/EPMU HLD ngày 13/7/2015).
Khi đưa vào khai thác nhánh X, Y ngày 14/7/2015, TVGS cũng chấp thuận ngày hoàn thành nhánh X, Y là ngày 14/7/2015 như đã nêu trong “chứng chỉ bàn giao công trình”.
Như vậy, chậm 138 ngày (26/2/2015 đến 14/7/2015) là do dự án xây dựng hệ thống thoát nước đường Đỗ Xuân Hợp đang thi công, không thể kết nối với nhánh X, Y để đưa vào khai thác. Vì vậy đây không phải trách nhiệm nhà thầu.
Rất mong sự xem xét và chấp thuận của các Ông.

Reference letter Consulting LPk8CHD-16-019 dated 01.18.2016 regarding Annex contract for extension of time to complete the package 8.

Contractors Pack finished 8 branches X, Y before 26.02.2015 day, but can not put into the project operated for sewer line Xuan Hop street construction has not finished, so the car can not be up, down Branch X, Y. (Attach BBNT)
After the project "Construction of sewer Xuan Hop street" complete culverts and pavement, ensure vehicle traffic up and down the branches X, Y. On 13 / 7/2015 PMU HCM - LT - DG invites exploitation handed arm X, Y from the date 07.14.2015 (Letter 474 / EPMU HLD date 07.13.2015).
Once put into operation branch X, Y dated 07.14.2015, Supervision consultant also approved completion date branched X, Y is the date 07.14.2015 as stated in "handing over the project certificate".
Thus, the delay of 138 days (26 / 2/2015 to 14/07/2015) is due to construction projects of sewer Xuan Hop street under construction, can not connect to the branch X, Y to put into operation. So it was not responsible contractors.
