Điều 41. Kiểm tra và giám sát
1. Bộ Tài chính có trách nhiệm giám sát thường xuyên việc thực hiện các nghĩa vụ của người được bảo lãnh:
a) Tiến độ rút vốn theo kế hoạch đã đăng ký.
b)Thực hiện nghĩa vụ trả nợ.
c) Bố trí vốn chủ sở hữu theo quy định.
d) Thực hiện nghĩa vụ về thế chấp tài sản.
đ) Giám sát việc thực hiện các cam kết bổ sung theo yêu cầu của Chính phủ, Thủ tướng Chính phủ đối với người được bảo lãnh trong từng trường hợp cụ thể.
2. Trong trường hợp người được bảo lãnh có dấu hiệu khó khăn về tài chính hoặc phát sinh tình trạng không trả được nợ theo Điều 15 Nghị định này, Bộ Tài chính tiến hành kiểm tra tình hình tài chính của dự án, xác định nguyên nhân mất khả năng thanh toán và báo cáo Thủ tướng Chính phủ biện pháp xử lý.

Article 41. Inspection and supervision
1. The Ministry of Finance is responsible for regular monitoring of the implementation of the obligations of the guarantee:
a) Progress of withdrawal under the registered plan.
b) Performance of the obligation to repay.
c) To allocate capital owns prescribed.
d) Perform duties on mortgage assets.
e) Monitoring the implementation of additional commitments at the request of the Government, Prime Minister, for people to be guaranteed in every case case.
2. In case the guaranteed show signs of financial difficulty or arising situation not repay their debts under Article 15 of this Decree, the Ministry of Finance shall examine the financial status of the project, determining the cause inability to pay and report to the Prime Minister remedies.
