12.5.4. Các trường hợp điều chỉnh thời hạn thi công xây dựng Dự án phải được chấp thuận của [Bbb] và phải được lập thành Phụ lục điều chỉnh Hợp đồng BOT. Khi điều chỉnh thời hạn thi công công trình, Nhà đầu tư có nghĩa vụ làm thủ tục để điều chỉnh Giấy chứng nhận đăng ký đầu tư.
12.5.5. Doanh nghiệp dự án chịu trách nhiệm quản lý Dự án, tổ chức thi công xây dựng Công trình dự án và thanh toán kịp thời cho nhà thầu xây dựng (trường hợp Doanh nghiệp dự án không tự thực hiện) theo đúng tiến độ theo Hợp đồng BOT, phù hợp với Hợp đồng giữa Doanh nghiệp dự án với các nhà thầu xây dựng. Việc thực hiện quản lý tiến độ bao gồm:
a. Tổ chức lập tiến độ thi công xây dựng Công trình dự án (trình [Bbb] thông qua trước khi chính thức tổ chức thi công và chậm nhất 01 tháng kể từ ngày ký Hợp đồng BOT này); trên cơ sở đó lập tiến độ thi công chi tiết các hạng mục phù hợp tiến độ thi công xây dựng Công trình dự án đã được chấp thuận; thực hiện tiến độ thi công các gói thầu xây lắp bảo đảm phù hợp với tiến độ tổng thể của Dự án; gửi [Bbb] tiến độ thi công chi tiết và tiến độ thi công điều chỉnh (nếu có) để theo dõi.

Chủ trì, phối hợp với nhà thầu thi công xây dựng, tư vấn giám sát và các bên có liên quan kiểm tra, giám sát tiến độ thi công xây dựng Công trình dự án và từng gói thầu, và điều chỉnh tiến độ trong trường hợp tiến độ thi công xây dựng ở một số giai đoạn bị kéo dài nhưng không được làm ảnh hưởng đến tiến độ tổng thể của Dự án.
c. Trường hợp xét thấy tiến độ tổng thể của Dự án bị kéo dài thì Doanh nghiệp dự án đề nghị [Bbb] quyết định điều chỉnh tiến độ tổng thể của Dự án.
d. Hằng tháng, Doanh nghiệp dự án có trách nhiệm cập nhật, điều chỉnh tiến độ, đưa ra các biện pháp khắc phục trong trường hợp chậm tiến độ gửi [Bbb] để theo dõi.
e. Trường hợp chậm tiến độ thì các khối lượng chậm tiến độ so với Hợp đồng BOT này, Nhà đầu tư, Doanh nghiệp dự án phải báo cáo [Bbb] xem xét chấp thuận việc điều chỉnh giá.
