Ví dụ như trường hợp Anh Jeans Phan Dũng, một người Pháp gốc Việt có vợ ở Việt Nam nên hai năm nay anh ở TP.HCM và đang tính toán để mua một căn nhà. Vì vợ chồng anh có tài khoản riêng và không muốn gộp thành tài sản chung trong thời kì hôn nhân, nên anh sẽ đứng riêng để mua một ngôi nhà. Tuy nhiên, còn nhiều khó khăn mà anh vẫn chưa biết cách giải quyết.
“Tôi thấy khá phức tạp. Ví dụ như người nước ngoài như tôi chưa được đăng kí thuê bao đồng hồ điện, nước. Càng khó khăn hơn nếu tôi muốn vay vốn ngân hàng để mua một căn nhà. Hiện nay chưa có quy định nào của ngân hàng cho người nước ngoài mở tài khoản, hay vay vốn ở Việt Nam. Thời gian sở hữu một căn nhà của người nước ngoài chỉ có 50 năm. Tôi thấy lo lắng”. Anh Dũng nói.

Theo luật sư Đào Ngọc Hùng, Đoàn luật sư TP. HCM, những lời của Dũng đang là một thực tế ở Việt Nam hiện nay. Ngày 1.7, Luật Nhà ở 2014 có hiệu lực nhưng vẫn chưa có Nghị định hay Thông tư hướng dẫn những vướng mắc cho người nước ngoài mua nhà.

Một rào cản khác cũng khiến người nước ngoài quan tâm là khi mua nhà, họ sẽ đem một khoản ngoại tệ lớn vào Việt Nam. Đến khi họ bán ngôi nhà thì số tiền đó sẽ gặp nhiều rắc rối nếu muốn mang ra khỏi Việt Nam bởi các quy định chống rửa tiền, trốn thuế, hay các thủ tục hải quan...

Theo luật sư Đào Ngọc Hùng, thực ra thì chỉ cần khai báo với chính quyền sở tại thì người nước ngoài có thể đem tiền đi. Nhưng, những chuyện như vậy sẽ làm người nước ngoài bớt hứng thú hơn với thị trường.

Ông Châu Thanh Hãn, Phó Giám đốc Công ty cổ phần đầu tư Phú Cường, đơn vị chủ đầu tư dự án chung cư Bộ Công an cho rằng, doanh nghiệp sẽ còn gặp phải nhiều rối rắm khác khi bán nhà cho người nước ngoài, ví dụ như các thủ tục sẽ tiến hành ra sao, các văn bản, quy định... còn chưa thống nhất với nhau.

Từ đó, các doanh nghiệp sẽ ngại bán nhà cho người nước ngoài vì quá nhiêu khê. Trong khi đó, cũng với mức lợi nhuận tương tự, nhưng bán nhà cho người Việt Nam dễ hơn rất nhiều.

Trao đổi với phóng viên, chủ một doanh nghiệp địa ốc tâm sự: “Nếu chỉ chờ vào việc bán nhà cho người nước ngoài, không khác gì ngồi chờ phá sản. Tôi hi vọng khi có Nghị định và Thông tư hướng dẫn thì thị trường tốt hơn”.
