Tiến trình Tái định cư nhân đạo (HR)

Thông tin về Thỏa thuận giữa Chính phủ Việt Nam và Hoa Kỳ về Tiến trình Tái định cư nhân đạo (HR)
Ngày 15-11-2005, Chính phủ Việt Nam đã ký thoả thuận cuối cùng với Chính phủ Hoa Kỳ về việc mở Tiến trình tái định cư nhân đạo (HR). Theo đó, Chính phủ Việt Nam và Chính phủ Hoa Kỳ sẽ hợp tác trong việc xem xét và cho phép xuất cảnh tái định cư tại Hoa Kỳ những công dân Việt Nam thuộc đối tượng của Chương trình Ra đi có trật tự (ODP) nhưng trước đây chưa thể nộp đơn hoặc chưa thể hoàn tất hồ sơ trước khi Chương trình ODP kết thúc vào ngày 30-09-1994 vì lý khách quan như điều kiện kinh tế, không có điều kiện tiếp cận thông tin về chương trình ODP, hoặc do trước đây chưa muốn đi định cư tại Hoa Kỳ nên không nộp hồ sơ ODP…

Tiến trình này không áp dụng đối với những người trước đây đã nộp đơn theo Chương trình ODP nhưng đã bị từ chối hoặc đã được thông báo không đủ tiêu chuẩn theo Chương trình ODP. Tiến trình tái định cư nhân đạo (HR) sẽ được thông báo công khai rộng rãi trên các phương tiện thông tin đại chúng (truyền hình, báo, đài…) trong 6 tháng kể từ ngày 15-12-2005 và tiếp theo là giai đoạn 2 năm nhận và giải quyết các đơn.

Các đối tượng nêu trên bao gồm:

1. Công dân Việt Nam thuộc diện HO:

Là một trong những người sau:

a) Người nộp đơn là công dân Việt Nam đã trải qua ít nhất ba năm trong trại cải tạo do có mối liên hệ chặt chẽ với các cơ quan, tổ chức của Chính phủ Hoa Kỳ để thực hiện các chương trình hoặc các chính sách của Chính phủ Hoa Kỳ trước ngày 30 tháng 4 năm 1975;

b) Người nộp đơn là công dân Việt Nam có đủ hai điều kiện sau:

Đã từng trải qua ít nhất một năm trong trại cải tạo do có mối liên hệ chặt chẽ với Chính phủ Hoa Kỳ trước ngày 30 tháng 4 năm 1975;
Đã được đào tạo với thời hạn bất kỳ tại Hoa Kỳ hoặc trên lãnh thổ Hoa Kỳ dưới sự bảo trợ của Chính phủ Hoa Kỳ trước ngày 30 tháng 4 năm 1975;
c) Người nộp đơn là công dân Việt Nam có đủ hai điều kiện sau:

Đã từng trải qua ít nhất một năm trong trại cải tạo do có mối liên hệ chặt chẽ với Chính phủ Hoa Kỳ trước ngày 30 tháng 4 năm 1975;
Đã làm việc trực tiếp cho Chính phủ Hoa Kỳ hoặc một công ty Hoa Kỳ hoặc một tổ chức Hoa Kỳ trong thời gian ít nhất là một năm trước ngày 30 tháng 4 năm 1975;
d) Người nộp đơn là người goá chồng/ goá vợ của người bị đưa vào trại cải tạo do có mối liên hệ chặt chẽ của người đó với Chính phủ Hoa Kỳ trước ngày 30 tháng 4 năm 1975 và đã chết trong trại cải tạo hoặc chết trong vòng một năm sau khi được thả.

2. Công dân Việt Nam là cựu nhân viên Chính phủ Hoa Kỳ (diện U11):

Những nhân viên được tuyển dụng trực tiếp bởi Chính phủ Hoa Kỳ tại Việt Nam với thời gian làm việc được chứng minh tổng cộng từ 5 năm trở lên trong giai đoạn từ ngày 01 tháng 01 năm 1963 đến ngày 30 tháng 4 năm 1975.

3. Công dân Việt Nam là cựu nhân viên của công ty tư nhân hoặc tổ chức của Hoa Kỳ (diện V11):

Những nhân viên được tuyển dụng trực tiếp bởi các công ty tư nhân Hoa Kỳ hoặc các tổ chức của Hoa Kỳ với thời gian làm việc được chứng minh tổng cộng từ 5 năm trở lên trong giai đoạn từ ngày 01 tháng 01 năm 1963 đến ngày 30 tháng 4 năm 1975.

4. Thành viên gia đình trực tiếp đủ tiêu chuẩn:

Vợ hoặc chồng và các con chưa lập gia đình, chưa tròn 21 tuổi (vào thời điểm nộp đơn) của những người có đơn được chấp thuận.


Một số điểm cần lưu ý:

HR là một tiến trình MIỄN PHÍ và chỉ có những người có đủ điều kiện theo quy định trên mới được xét đơn.

Để tránh gây xáo trộn cuộc sống dẫn tới mất ổn định cho cộng đồng, người có đơn được nhận và xem xét không nên vội chuẩn bị cho việc xuất cảnh (thôi việc, bán nhà, bán tài sản, thôi học…) trước khi việc tái định cư được chấp thuận bằng quyết định chính thức của Bộ An ninh nội địa Hoa Kỳ.

Humanitarian resettlement process (HR)Information about the agreement between the Government of Vietnam and the United States about the relocation humane (HR)15-11-2005, Vietnam's Government has signed an agreement with the u.s. Government about opening humanitarian resettlement process (HR). Government employee (an U11):Those employees are employed directly by the us Government in Vietnam with working time proved a total of 5 years or more in the period from January 1, 1963 to April 30, 1975.3. Progress Humanitarian Resettlement (HR) Information Agreement between the Government of Vietnam and the United States of Procedure Humanitarian Resettlement (HR) On 15-11-2005, the Government of Vietnam has signed final agreements along with the US government about opening process Humanitarian Resettlement (HR). Accordingly, the Government of Vietnam and the Government of the United States will cooperate in the review and permitting the exit of resettlement in the United States citizens of Vietnam subject Departure Program orderly (ODP) but could not previously filed or may not complete dossier before the program ends on 30-09-1994 ODP because such objective economic conditions, with no access to information on ODP program, or by not previously want to migrate to the United States should not apply ODP ... Vietnam nationals subject HO: As one of the following: a) The applicant is a citizen of Vietnam has experienced at least three years in the camp due to close relationships with agencies, organizations The Government of the United States to implement the program or policies of the US government before April 30, 1975; b) The applicants are citizens of Vietnam with two conditions: Having experienced less least one year in the camp due to close ties with the US government before April 30, 1975, has been training for any period in the United States or on US territory under the auspices of US Government before April 30, 1975; c) The applicant is a citizen Vietnam with two conditions: Having experienced at least one year in the camp due to close ties with the US government before April 30, 1975; Having worked directly for the US government or a US company or a US organization in time for at least one year prior to April 30, 1975; d ) The applicants are widows / widowers of persons sent to camps linked so closely with the Government of the United States that before April 30, 1975 and died in camps or death Within a year after release. 2. Vietnam citizen is a former employee of the US government (U11 area): These employees are employed directly by the US government in Vietnam work with time proven a total of 5 years or more in the period 01 stages from 01 May 1963 to 30 April 1975. 3. Vietnam citizen is a former employee of a private company or organization by the United States (V11 interface): The staff are employed directly by the US private companies or organizations in the United States with time Work proven total of 5 years or more in the period from 01 May 1963 to 01 April 30, 1975. 4. Direct family members eligible: Spouses and unmarried children, not yet 21 years old (at the time of application) of those applications are approved. Some points to note: HR is FREE process and only those who are eligible under the above provisions shall be considered a new application.
