Điều 112. Thẩm quyền và căn cứ quyết định miễn trừ
1. Cục Điều tiết điện lực có trách nhiệm xem xét và phê duyệt các trường hợp được miễn trừ thực hiện quy định tại Điều 110 Thông tư này.
2. Các cơ sở để xem xét miễn trừ thực hiện bao gồm:
a) Quyền của các bên trong các hợp đồng đã được ký kết trước khi Thông tư này có hiệu lực;
b) Ý kiến của Đơn vị truyền tải điện, Đơn vị vận hành hệ thống điện và thị trường điện về ảnh hưởng của việc miễn trừ thực hiện tới việc đảm bảo các tiêu chuẩn vận hành hệ thống điện;
c) Chi phí cho đơn vị đề nghị được miễn trừ thực hiện nếu phải đầu tư nâng cấp để đáp ứng các tiêu chuẩn quy định tại Thông tư này;
d) Các chi phí phát sinh trong hệ thống điện nếu đơn vị đề nghị được phép miễn trừ thực hiện;
đ) Thời hạn đề nghị được hưởng miễn trừ thực hiện;
e) Các thông tin khác liên quan đến đề nghị được miễn trừ thực hiện.
