11. Tóm tắt các kết quả của luận văn:
Luận văn đã đi sâu nghiên cứu về tội mua bán, đánh tráo, chiếm đoạt trẻ em trong Luật hình sự Việt Nam như: quan niệm về trẻ em theo quy định của pháp luật và sự cần thiết phải bảo vệ quyền con người của trẻ em bằng các quy định của Luật hình sự Việt Nam; khái quát lịch sử Luật hình sự Việt Nam quy định về tội mua bán, đánh tráo hoặc chiếm đoạt trẻ em từ khi thành lập nước năm 1945 đến nay và quy định về tội mua bán, đánh tráo, chiếm đoạt trẻ em của một số nước trên thế giới.
Nghiên cứu cụ thể khái niệm và các dấu hiệu pháp lý về tội mua bán, đánh tráo, chiếm đoạt trẻ em; đường lối xử lý đối với các trường hợp phạm tội; tình hình hoạt động điều tra, truy tố, xét xử tội phạm mua bán, đánh tráo, chiếm đoạt trẻ em trên địa bàn tỉnh Hà Giang từ năm 2010 đến năm 2014. Trên cơ sở khảo sát số liệu thực tiễn, phân tích, đánh giá, so sánh, tổng hợp và diễn biến tội phạm, luận văn đã rút ra những ưu điểm, những tồn tại, nguyên nhân vướng mắc, đề xuất một số giải pháp nâng cao hiệu quả công tác điều tra, truy tố, xét xử tội phạm mua bán, đánh tráo, chiếm đoạt trẻ em và đưa ra một số giải pháp nâng cao hiệu quả áp dụng các quy định Tội mua bán, đánh tráo, chiếm đoạt trẻ em trên địa bàn tỉnh Hà Giang; đã đề xuất hoàn thiện pháp luật về tội mua bán, đánh tráo, chiếm đoạt trẻ em trong Bộ luật hình sự Việt Nam theo hướng tách điều 120 Bộ luật hình sự hiện hành thành 3 tội danh riêng biệt, đó là: tội mua bán trẻ em, tội đánh tráo trẻ em và tội chiếm đoạt trẻ em; đề xuất tăng khung hình phạt chính (tăng mức phạt tù) và hình phạt bổ xung (tăng tiền phạt)... nhằm xử lý nghiêm minh các hành vi phạm tội và hạn chế tội phạm mua bán, đánh tráo, chiếm đoạt trẻ em.

Khả năng ứng dụng trong thực tiễn: Tài liệu luận văn là cơ sở để cán bộ các cơ quan tiến hành tố tụng nghiên cứu, vận dụng trong quá trình phòng ngừa, phát hiện, điều tra, truy tố, xét xử tội mua bán, đánh tráo, chiếm đoạt trẻ em; là tài liệu để các nhà nghiên cứu, cán bộ các cơ quan Công an, Viện kiểm sát, tòa án tham khảo trong quá trình công tác, học tập nhằm nâng cao hiệu quả công tác phòng ngừa, phát hiện, điều tra, truy tố, xét xử đối với tội phạm mua bán, đánh tráo, chiếm đoạt trẻ em nói chung và trên địa bàn
