Bảo hiểm và bảo hành chất lượng công trình:
Bên B có trách nhiệm mua bảo hiểm cho tài sản, máy móc thiết bị phục vụ thi công; Bảo hiểm cho người lao động; Bảo hiểm trách nhiệm dân sự cho người thứ ba theo quy định của pháp luật.
Bên B có trách nhiệm thực hiện bảo hành công trình sau khi bàn giao cho Chủ đầu tư. Nội dung bảo hành công trình bao gồm khắc phục, sửa chữa, thay thế thiết bị hư hỏng, khiếm khuyết hoặc khi sử dụng công trình do lỗi của nhà thầu gây ra.
Bên B phải tiến hành bảo hành trong vòng 7 ngày kể từ ngày nhận được thông báo của bên A. Trong khoảng thời gian này, nếu bên B không tiến hành bảo hành thì bên A có quyền đề nghị ngân hàng (đã phát hành chứng thư bảo lãnh bảo hành công trình này) của bên B chuyển trả toàn bộ 5% số tiền bảo lãnh bảo hành công trình về tài khoản của bên A, để bên A thuê tổ chức, cá nhân khác sửa chữa. Bảo lãnh bảo hành của ngân hàng bên B phải ghi rõ: ”Khi bên A có đề nghị nhận tiền bảo lãnh bảo hành công trình thì ngân hàng chuyển tiền cho bên A” .
