Chánh thanh tra Sở Tài nguyên và Môi trường và chức danh tương đương được Chính phủ giao thực hiện chức năng thanh tra chuyên ngành bảo vệ môi trường có thẩm quyền xử phạt vi phạm hành chính trong lĩnh vực bảo vệ môi trường theo thẩm quyền và trách nhiệm kiểm tra, thanh tra về bảo vệ môi trường trên địa bàn tỉnh, thành phố trực thuộc Trung ương quản lý;
Chánh thanh tra Bộ Tài nguyên và Môi trường, Tổng cục trưởng Tổng cục Môi trường, Cục trưởng Cục Kiểm soát ô nhiễm và chức danh tương đương được Chính phủ giao thực hiện chức năng thanh tra chuyên ngành bảo vệ môi trường có thẩm quyền xử phạt vi phạm hành chính trong lĩnh vực bảo vệ môi trường theo thẩm quyền trên phạm vi cả nước.
