Theo thông lệ chung, khi có sự kiện bất khả kháng thì bên bị ảnh hưởng bởi sự kiện bất khả kháng phải gửi thông báo cho bên kia trong một thời hạn hợp lý. Tuy nhiên thông thường, các bên quy định rõ thời hạn thông báo và hậu quả của việc không thông báo: Nếu không thông báo thì sẽ mất quyền được miễn trách nhiệm hoặc kéo dài thời hạn thực hiện hợp đồng. Trong trường hợp nếu các bên không có thỏa thuận cụ thể về hậu quả của việc không thông báo, thì các bên sẽ tuân theo luật áp dụng để giải quyết. Theo nguyên tắc chung của phần lớn luật áp dụng, nếu bên bị ảnh hưởng bởi sự kiện bất khả kháng vi phạm nghĩa vụ thông báo thì sẽ không được hưởng quyền miễn trừ trách nhiệm do sự kiện bất khả kháng.
