Điều 44. Kiểm tra, giám sát hải quan đối với hàng hóa trung chuyển
1. Hàng hóa trung chuyển là hàng hóa từ nước ngoài đưa vào khu vực trung chuyển, sau đó được đưa ra nước ngoài trực tiếp từ khu vực trung chuyển này; không được vận chuyển trong lãnh thổ Việt Nam để xuất khẩu qua cửa khẩu khác trừ trường hợp thực hiện theo điều ước quốc tế mà Việt Nam là thành viên hoặc quyết định của Thủ tướng Chính phủ. Hàng hóa trung chuyển được đưa ra nước ngoài toàn bộ hoặc từng phần của lô hàng đã chuyển vào cảng.
2. Hàng hóa trung chuyển phải được thông báo với cơ quan hải quan, chịu sự giám sát hải quan trong suốt quá trình lưu giữ tại cảng. Việc kiểm tra thực tế hàng hóa trung chuyển chỉ áp dụng trong trường hợp có dấu hiệu vi phạm pháp luật.
3. Trách nhiệm của người kinh doanh dịch vụ trung chuyển hàng hóa:
a) Thông báo hàng hóa trung chuyển cho cơ quan hải quan theo mẫu do Bộ Tài chính ban hành;
b) Chịu trách nhiệm đảm bảo nguyên trạng hàng hóa trong suốt quá trình hàng hóa lưu giữ tại cảng;
c) Theo ủy quyền của chủ hàng, người kinh doanh dịch vụ trung chuyển hàng hóa được thực hiện các dịch vụ gia cố bao bì, chia gói, đóng gói lại để bảo quản hàng hóa phù hợp với yêu cầu vận chuyển hoặc trường hợp được gia công, chế biến theo quy định của Thủ tướng Chính phủ;
d) Hàng hóa trung chuyển được đóng ghép với hàng hóa khác để xuất khẩu.

Điều 45. Tài sản di chuyển
1. Người nước ngoài đưa tài sản di chuyển vào Việt Nam, khi làm thủ tục hải quan phải nộp:
a) Tờ khai hải quan: 02 bản chính;
b) Văn bản xác nhận đến công tác, làm việc tại Việt Nam của cơ quan, tổ chức nơi người nước ngoài làm việc hoặc giấy phép làm việc tại Việt Nam do cơ quan có thẩm quyền cấp: 01 bản chụp;
c) Chứng từ vận tải trong trường hợp tài sản vận chuyển bằng đường biển, đường hàng không, đường sắt: 01 bản chụp.
2. Người nước ngoài chuyển tài sản di chuyển ra khỏi Việt Nam, khi làm thủ tục hải quan phải nộp:
a) Tờ khai hải quan: 02 bản chính;
b) Văn bản chứng minh hết thời gian làm việc: 01 bản chụp;
