14.2 Thủ tục tạm ngừng:
a) Bên có ý định tạm ngừng gửi cho Bên còn lại thông báo bằng văn bản cảnh báo để Bên còn lại khắc phục trong thời hạn 10 (mười) ngày, kể từ ngày thông báo.
b) Quá thời hạn khắc phục trên mà không khắc phục được thì Bên có ý định tạm dừng gửi cho Bên còn lại thông báo bằng văn bản tạm dừng, trong đó nêu rõ lý do và thời hạn tạm dừng; trường hợp bên tạm dừng không thông báo mà tạm dừng gây thiệt hại thì phải bồi thường cho bên thiệt hại;
c) Quá thời hạn tạm ngừng, các bên phải có trách nhiệm thương lượng, giải quyết để tiếp tục thực hiện đúng thỏa thuận hợp đồng, nếu Bên nào không tiếp tục thực hiện hợp đồng sẽ được coi là huỷ ngang hợp đồng và phải đền bù cho bên còn lại số tiền bằng 30% giá trị hợp đồng.
