Điều 1. Phạm vi điều chỉnh và đối tượng áp dụng
1. Thông tư này quy định việc sử dụng vật liệu xây không nung trong các công trình xây dựng.
Vật liệu xây không nung bao gồm:
- Gạch xi măng - cốt liệu;
- Vật liệu nhẹ (gạch từ bê tông khí chưng áp, gạch từ bê tông khí không chưng áp, gạch từ bê tông bọt, tấm Panel từ bê tông khí chưng áp);
- Tấm tường thạch cao, tấm 3D;
- Gạch khác (đá chẻ, gạch đá ong, vật liệu xây không nung từ đất đồi và phế thải xây dựng, phế thải công nghiệp, gạch silicát...).

Điều 2. Các công trình xây dựng bắt buộc sử dụng vật liệu xây không nung
1. Các công trình xây dựng được đầu tư bằng nguồn vốn Nhà nước theo quy định hiện hành bắt buộc phải sử dụng vật liệu xây không nung theo lộ trình:
+ Tại các đô thị loại 3 trở lên phải sử dụng 100% vật liệu xây không nung kể từ ngày Thông tư này có hiệu lực.
+ Tại các khu vực còn lại phải sử dụng tối thiểu 50% vật liệu xây không nung kể từ ngày Thông tư này có hiệu lực đến hết năm 2015, sau năm 2015 phải sử dụng 100%.
2. Các công trình xây dựng từ 9 tầng trở lên không phân biệt nguồn vốn, từ nay đến năm 2015 phải sử dụng tối thiểu 30% và sau năm 2015 phải sử dụng tối thiểu 50% vật liệu xây không nung loại nhẹ trong tổng số vật liệu xây (tính theo thể tích khối xây).
