Một trong những yêu cầu cơ bản của việc xây dựng và hoàn thiện Nhà nước Việt Nam là Nhà nước phải quản lý xã hội bằng pháp luật. Trong hệ thống các văn bản pháp luật, thì Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam là luật cơ bản của Nhà nước, có hiệu lực pháp lý cao nhất; mọi văn bản pháp luật khác phải phù hợp với Hiến pháp. Các văn bản dưới luật do các cơ quan Nhà nước có thẩm quyền ban hành phải phù hợp và không được trái với các quy định của Hiến pháp và luật.
