Hai bên cùng thống nhất thỏa thuận nội dung hợp đồng như sau:
Điều 1: Tài sản cho thuê:
Bên A đồng ý cho bên B thuê một máy Photocopy hiệu RICOH như sau:
1- Model máy: AF MP2851 Số S/N: V8214901139 Bộ phận chọn thêm:
2- Giá trị sử dụng : Đã sử dụng.
Điều 2: Thời hạn cho thuê và trị số của đồng hồ tại thời điểm ký Hợp đồng:
1- Thời hạn từ ngày: 01/06/2016 Đến ngày: 31/05/2017
2- Chỉ số đồng hồ của máy tại thời điểm ký Hợp đồng là:
Điều 3: Giá cho thuê máy:
1- Giá của một bản chụp là: Giá A= 0 VNĐ/bảng.
2- Giá tối thiểu hàng tháng là: Giá B= 0 VNĐ/tháng.
3- Giá thuê máy hàng tháng là : Giá C = 0 VNĐ/tháng.
4- Số bản chụp hàng tháng được tính như sau:
Số bản chụp = (Chỉ số đồng hồ tháng hiện tại) – (Chỉ số đồng hồ tháng trước).
5- Tất cả giá trên chưa bao gồm thuế GTGT 10%
Điều 4: Phương thức tính và thanh toán chi phí:
Bên B:
1- Bên B đồng ý thanh toán trước cho bên A số tiền đặc cọc là: 0 VNĐ.
2- Nếu số bản chụp ít hơn hoặc bằng 0 bản: thanh toán cho bên A giá B + Giá C
2- Nếu số bản chụp nhiều hơn 0 bản: thanh toán cho bên A theo phương thức sau:
Số tiền/tháng = (Số bản chụp X giá A) + Giá C
3- Hàng tháng, căn cứ vào số bản chụp được xác nhận giữa hai bên để Bên A tiến hành xuất hóa đơn cho Bên B.
4- Bên B thanh toán cho bên A trong vòng 07 ngày kể từ ngày Bên B nhận được hóa đơn của Bên A.
Bên A:
1- Hoàn trả lại số tiền cọc cho bên B khi kết thúc hợp đồng.
Điều 5: Chi phí vận chuyển máy:
1- Trong Bình Dương: Bên A thanh toán toàn bộ các chi phí vận chuyển.
2- Ngoài Bình Dương: Hai bên cùng thoả thuận trong mỗi trường hợp cụ thể.
Điều 6: Điều kiện về chất lượng hoạt động của máy:
Bên A:
1- Có trách nhiệm đảm bảo cho máy luôn luôn hoạt động trong tình trạng tốt.
2- Cung cấp miễn phí các dịch vụ bảo trì, sửa chữa, vật tư thay thế, mực và dầu.
Bên B:
1- Bảo đảm các điều kiện về bảo quản máy:
Nguồn điện xoay chiều, nơi đặt máy, nhiệt độ môi trường xung quanh, độ ẩm: đúng tiêu chuẩn của nhà sản xuất.
2- Sử dụng máy đúng thao tác, dùng giấy đúng tiêu chuẩn, tránh vật lạ rơi vào máy.
3- Không tự ý sửa chữa hoặc nhờ nhân viên kỹ thuật không phải của bên A sửa chữa.
Điều 7: Điều khoản về thay thế vật tư và tiền công sửa chữa:
Bên B:
Thanh toán cho bên A chi phí sửa chữa và vật tư thay thế trong các trường hợp hư hỏng sau:
a- Nguời sử dụng gây ra hoặc do kỹ thuật viên không phải của bên A sửa chữa.
b- Thiên tai, hỏa hoạn, sét đánh, nguồn điện không ổn định.
Bên A:
a- Giám định, gởi báo giá tiền công sửa chữa.
b- Thay thế vật tư chính phẩm.
Điều 8: Điều kiện đáp ứng trong sửa chữa và bảo trì:
Bên B:
1- Có trách nhiệm thông báo rõ ràng các sự cố hư hỏng cho Bên A bằng số 0650.843.888.
2- Cử nhân viên có trách nhiệm để tiếp xúc với kỹ thuật viên.
Bên A:
1- Thời gian sửa chữa và bảo trì từ thứ Hai đến thứ Sáu hàng tuần.
Sáng từ: 7:30 đến 12:00, chiều từ 13:00 đến 17:00
Riêng thứ Bảy: chỉ làm việc buổi sáng từ: 7:30 đến 11:30.
2- Thời gian đáp ứng:
a- Trong Bình Dương: 04 giờ (không tính thời gian di chuyển) kể từ lúc Bên B báo.
b- Ngoài Bình Dương : Thỏa thuận trong mỗi trường hợp cụ thể.
3- Trong trường hợp sửa chữa lâu: bên A cung cấp 01 máy tạm sử dụng.
Điều 9: Hiệu lực hợp đồng:
1- Hợp đồng có hiệu lực kể từ ngày được hai bên ký kết.
2- Hợp đồng được xem như đã thanh lý khi hai bên đã hoàn thành đầy đủ các nghĩa vụ của mình theo các quy định của hợp đồng mà không có bất kỳ khiếu nại nào.
3- Nếu một bên cần thay đổi nội dung của các điều khoản trong Hợp đồng thì phải thông báo cho bên còn lại trước 10 ngày để cùng nhau bàn bạc và giải quyết vấn đề một cách thống nhất.
4- Nếu bên nào đơn phương vi phạm Hợp đồng sẽ chịu trách nhiệm theo kết luận của Tòa án kinh tế tỉnh Bình Dương xét xử theo qui định của pháp lệnh HĐKT hiện
