Nhưng mãi đến tháng 11 năm 2009 khi 8 tập đoàn đã thành lập và hoạt động được 3 đến 4 năm và ngay tại thời điểm Quốc hội đang giám sát về tập đoàn thì Chính phủ mới có Nghị định 101 về thí điểm thành lập tập đoàn kinh tế nhà nước.
