Tại Việt Nam, việc xét xử của tòa á

Tại Việt Nam, việc xét xử của tòa án thực hiện qua hai cấp: sơ thẩm ( hay gọi nôm na là xử lần 1) và phúc thẩm (xử lần 2).

Tòa án khi xét xử sẽ đưa ra phán quyết của mình, gọi chung là “bản án”.

Bản án của tòa án xử sơ thẩm gọi là Bản án sơ thẩm. Bản án sơ thẩm có thể bị kháng cáo ( hay còn gọi là chống án) bởi các đương sự (nguyên đơn, bị đơn, người có quyền lợi nghĩa vụ liên quan …) – trong vòng 15 ngày kể từ ngày tuyên án.

Bản án sơ thẩm chưa có hiệu lực pháp luật ngay và nếu không bị kháng cáo thì sau 15 ngày được xem là có hiệu lực pháp luật. Tức là có tính bắt buộc phải thi hành. Ví dụ: ông A kiện đòi ông B 100 triệu đồng. Tòa án Quận 10 xử sơ thẩm xử tuyên ông B phải trả cho ông A 100 triệu đồng. Ông B thấy tòa xử đúng nên không kháng cáo bản án sơ thẩm. Sau 15 ngày kể từ ngày tuyên án, bản án sẽ chính thức có hiệu lực pháp luật. Nghĩa là từ lúc này, việc phải trả 100 triệu cho ông A là “bắt buộc” đối với ông B.

Bản án sơ thẩm bị kháng cáo sẽ được xét xử phúc thẩm.

Bản án của tòa phúc thẩm gọi là Bản án phúc thẩm, có hiệu lực pháp luật ngay (chung thẩm), không ai được kháng cáo nữa.

Tuy nhiên, bất kỳ bản án nào - dù đã có hiệu lực pháp luật, mà sau đó phát hiện có vi phạm pháp luật hoặc có tình tiết mới thì sẽ được xem xét lại theo trình tự giám đốc thẩm hoặc tái thẩm. ( Vấn đề này chúng tôi sẽ có dịp trình bày sau).
