ĐIỀU 7 : BẤT KHẢ KHÁNG
- Sự kiện bất khả kháng là sự kiện xảy ra mang tính khách quan và nằm ngoài tầm kiểm soát của các bên như hỏa hoạn, chiến tranh, thiên tai hoặc có nguy cơ xảy ra chiến tranh, …, và các thảm họa khác chưa lường hết được, sự thay đổi chính sách hoặc ngăn cấm của cơ quan có thẩm quyền của Việt Nam hoặc Nhà máy sản xuất của bên mua bị đình trệ sản xuất và các trường hợp khác theo qui định của pháp luật Việt Nam hiện hành.
- Trong trường hợp xảy ra sự kiện bất khả kháng, thời gian thực hiện hợp đồng sẽ được kéo dài bằng thời gian diễn ra sự kiện bất khả kháng mà bên bị ảnh hưởng không thể thực hiện các nghĩa vụ theo hợp đồng của mình.
- Bên gặp sự kiện bất khả kháng xuất trình giấy chứng minh sự kiện bất khả kháng của cơ quan có thẩm quyền tại nơi xảy ra sự kiện bất khả kháng cho bên kia trong vòng 7 ngày làm việc kể từ ngày xảy ra sự kiện bất khả kháng.
- Bên gặp sự kiện bất khả kháng phải nỗ lực hết sức để khắc phục và tiếp tục thực hiện hợp đồng ngay sau khi chấm dứt sự kiện bất khả kháng. Trong trường hợp sự kiện bất khả kháng dẫn đến sự việc không thể tiếp tục thực hiện hợp đồng thì các bên phải bàn bạc để chấm dứt hợp đồng.

ARTICLE 7: FORCE MAJEURE
