Phế liệu là sản phẩm, vật liệu bị loại ra từ quá trình sản xuất hoặc tiêu dùng được thu hồi để dùng làm nguyên liệu sản xuất.
Doanh nghiệp có thể tự mình trực tiếp nhập khẩu hoặc ủy thác cho một bên thứ ba để thực hiện việc nhập khẩu phế liệu thông qua hợp đồng ủy thác nhập khẩu.
Đối với doanh nghiệp trực tiếp sử dụng phế liệu nhập khẩu làm nguyên liệu sản xuất phải đáp ứng các điều kiện và đã được cấp Giấy chứng nhận, cụ thể như sau:
• Có cơ sở sản xuất;
• Sử dụng phế liệu nhập khẩu để làm nguyên liệu sản xuất ra sản phẩm tại cơ sở sản xuất của doanh nghiệp;
• Có kho bãi (có quyền sở hữu hoặc đồng sở hữu, hoặc thuê) dành riêng cho việc tập kết phế liệu bảo đảm các điều kiện về bảo vệ môi trường;
• Có công nghệ, thiết bị để tái chế phế liệu nhập khẩu làm nguyên liệu cho sản xuất;
• Có phương án, giải pháp xử lý phế liệu nhập khẩu đáp ứng yêu cầu bảo vệ môi trường; đảm bảo mọi chất thải từ quy trình sản xuất đều được xử lý đạt quy chuẩn kỹ thuật về môi trường;
• Đã chấp hành tốt các quy định của pháp luật về bảo vệ môi trường.
Đối với doanh nghiệp nhận ủy thác phải đáp ứng các điều kiện sau:
• Có hợp đồng ủy thác nhập khẩu. Hợp đồng này được ký kết với thương nhân đã được cấp Giấy chứng nhận.
• Nội dung hợp đồng ủy thác phải ghi rõ các nội dung như sau:
o Loại phế liệu nhập khẩu và thành phần phế liệu nhập khẩu phù hợp với Giấy chứng nhận được cấp;
o Phế liệu nhập khẩu phải thuộc Danh mục phế liệu nhựa được phép nhập khẩu làm nguyên liệu sản xuất;
o Phế liệu nhập khẩu phải đáp ứng Quy chuẩn kỹ thuật quốc gia về môi trường đối với phế liệu nhựa nhập khẩu QCVN 32:2010/BTNMT do Bộ Tài nguyên và Môi trường ban hành.
• Nội dung hợp đồng nhập khẩu phế liệu nhựa phải ghi rõ:
o Nguồn gốc, thành phần phế liệu nhựa nhập khẩu phù hợp với hợp đồng ủy thác;
o Cam kết tái xuất phế liệu trong trường hợp phế liệu nhập khẩu về đến cửa khẩu nhưng không đạt các yêu cầu theo quy định.
Điều kiện đối với phế liệu nhập khẩu
Phế liệu nhập khẩu phải thuộc Danh mục phế liệu được phép nhập khẩu làm nguyên liệu sản xuất;
Phế liệu nhập khẩu đã được làm sạch để loại bỏ chất thải, những loại vật liệu, vật phẩm, hàng hóa cấm nhập khẩu theo quy định của pháp luật Việt Nam và các điều ước quốc tế mà Việt Nam là thành viên;
Phế liệu nhựa nhập khẩu đã được lựa chọn, phân loại riêng biệt theo mã HS, tên phế liệu, mô tả phế liệu, yêu cầu chất lượng phù hợp với quy định của pháp luật;
Phế liệu nhựa nhập khẩu phải đáp ứng Quy chuẩn kỹ thuật quốc gia về môi trường đối với phế liệu nhựa nhập khẩu QCVN 32:2010/BTNMT do Bộ Tài nguyên và Môi trường ban hành;
Đối với những loại phế liệu mới phát sinh nhưng chưa có trong Danh mục phế liệu được phép nhập khẩu, doanh nghiệp vẫn có thể nhập khẩu nếu được Bộ Tài nguyên và Môi trường xem xét và chấp thuận.
Phế liệu nhựa được phép nhập khẩu bao gồm:
Phế liệu và mẩu vụn của plastic (nhựa) từ polyme etylen (PE): Dạng xốp, không cứng.
Phế liệu và mẩu vụn của plastic (nhựa) từ polyme etylen (PE): Loại khác.
Phế liệu và mẩu vụn của plastic (nhựa) từ polyme styren (PS): Dạng xốp, không cứng.
Phế liệu và mẩu vụn của plastic (nhựa) từ polyme styren (PS): Loại khác.
Phế liệu và mảnh vụn của plastic (nhựa) từ polyme vinyl clorua (PVC): Dạng xốp, không cứng.
Phế liệu và mảnh vụn của plastic (nhựa) từ polyme vinyl clorua (PVC): Loại khác.

• Use imported scrap as raw materials to produce products at production facilities of the enterprise;
• There warehouse (with ownership or co-ownership, or rental) dedicated to the scraps, ensuring the conditions for environmental protection;
• Having the technology and equipment to recycle waste as raw materials imported for production;
• Having a plan, waste disposal solutions import data to meet the requirements of environmental protection; ensure that all waste from the production process are treated to meet technical regulations on environment;
• Has good observance of the provisions of the law on environmental protection.
For the enterprises entrusted to meet the following conditions:
• There are entrusted import contract. This contract was signed with the trader have been granted certificates.
• Content fiduciary contract must specify the contents as follows:
o Types of imported scrap and scrap imported component matching Certificate received a grant;
o Scrap imports have on the list of licensed plastic scrap as raw materials imported for production;
o Scrap imports to meet national technical standards on environment for imported plastic scrap NTR 32: 2010 / BTNMT by the Ministry of Natural Resources and Environment issued.
• The contents of the plastic scrap import contract must specify:
o The origin, ingredients imported plastic scrap suit entrustment contract;
o Commitment to re-export of scrap in the case of imported scrap to the gate but did not meet the requirements prescribed.
Conditions for imported scrap
Scrap imports have on the list are allowed to import scrap as production materials;
Scrap imports were cleaned to eliminate waste, the materials, articles or prohibited goods imported under the provisions of the law of Vietnam and international treaties to which Vietnam is membership;
scrap imported plastic has been selected, a separate classification under the HS, the name of scrap, scrap description, quality requirements consistent with the provisions of law;

For the new arising scrap but not yet included in the list of scrap allowed to import, businesses can still be imported if the Ministry of Natural Resources and Environment for consideration and approval.
