ĐIỀU 2. HỒ SƠ HỢP ĐỒNG VÀ THỨ TỰ ƯU

ĐIỀU 2. HỒ SƠ HỢP ĐỒNG VÀ THỨ TỰ ƯU TIÊN:
2.1 Hồ sơ Hợp đồng bao gồm các căn cứ ký kết hợp đồng ; các điều khoản và điều kiện của hôp đồng này và các tài liệu tại khoản 2.2 dưới đây.
2.2 Các tài liệu kèm theo hợp đồng là bộ phận không tách rời của Hợp đồng tư vấn xây dựng. Các tài liệu kèm theo Hợp đồng và thứ tự ưu tiên để xử lý mâu thuẫn giữa các tài liệu bao gồm:
a) Quyết đinh phê duyệt kết quả đấu thầu số 48/QD-PC dated 17th of Apr, 2015 của ủy ban nhân dân thành phố bạc Liêu;
b) Thông báo kết quả đấu thầu số 04/TB-BQLCT của ban quản lý công trình xây dưng cơ bản thành phố Bạc Liêu ngày 20th of Apr, 2015.
c) Hồ sơ mời thầu của bên A;
d)Hồ sơ dự thầu của nhà thầu;
đ) Biên bản thương thảo hợp đồng; các sửa đổi, bổ sung bằng văn bản;
e) Các phụ lục của hợp đồng;
g) các tài liệu khác có liên quan.
ĐIỀU 3: TRAO ĐỔI THÔNG TIN:
3.1 Các thông báo, chấp thuận, chứng chỉ, quyết định,... đưa ra phải bằng văn bản được chuyển đến bên nhận bằng đường bưu điện, bằng fax hoặc email theo địa chỉ các bên đã quy định trong hợp đồng.
3.2 Trường hợp bên nào thay đổi địa chỉ liên lạc thì phải thông báo cho bên kia để đảm bảo việc trao đổi thông tin. Nếu bên thay đổi địa chỉ mà không thông báo cho bên kia thì phải chịu mọi hậu quả do việc thay đổi địa chỉ mà không thông báo.
ĐIỀU 4: LUẬT VÀ NGÔN NGỮ SỬ DỤNG TRONG HỢP ĐỒNG:
4.1 Hợp đồng này chịu sự điều chỉnh của hệ thống pháp luật việt nam
4.2 Ngôn ngữ của hợp đồng này được thể hiện bằng tiếng việt.

If the change of address without notifying the other party, they must bear all the consequences caused by the change of address without notice.Article 4: the LAW and the LANGUAGE USED in the CONTRACT:4.1 this contract is subject to the terms of the legal system in Vietnam4.2 the language of this contract is represented by the Vietnamese.

ARTICLE 2. CONTRACT DOCUMENTS AND ORDER OF PRIORITY:
2.1 Profile contracts, including the base contract signed; the terms and conditions of this Agreement and the documents in Clause 2.2 below.
2.2 The contract attached documents are integral parts of the construction consultancy contract. Documents attached to the contract and the order of priority for handling contradictions between documents include:
a) Decision approving the bidding results 48 / QD-PC dated 17th of May, 2015 of the Commission's City People Lieu silver;
b) Notification of bidding results 04 / TB-BQLCT management of capital construction projects city Lieu 20th day of May, 2015.
c) of the Bidding Documents A ;
d) The tender of the contractor;
e) Report on the contract negotiation; the amended and supplemented in writing;
e) The annex to the contract;
g) other documents concerned.
ARTICLE 3: EXCHANGE OF INFORMATION:
3.1 The notice, approval, certificate or decision ... given in writing to be transferred to the recipient by post, by fax or email to the address specified by the parties in the contract.
3.2 In case of any change in contact information, they must inform notify the other party in order to ensure the exchange of information. If the change of address without notifying the other party shall bear all consequences of the change of address without notification.
ARTICLE 4: LAW AND LANGUAGE USED IN THE CONTRACT:
4.1 This contract is subject regulation of the legal system Vietnam
4.2 Language of this contract is represented by Vietnamese.
