Hôm nay, ngày 06 tháng 11 năm 2013, tại trụ sở Tòa án nhân dân tỉnh Quảng Nam xét xử sơ thểm công khai vụ án thụ lý số 09/2013/TLST-HN&GĐ ngày 07 tháng 10 năm 2013 về việc "xin ly hôn" theo quyết định đưa vụ án ra xét xử số 07/2013/QĐST-HN&GĐ ngày 28 tháng 10 năm 2013, giữa các đương sự:
- Nguyên đơn: ông Nguyen Quang Trung, sinh năm: 1964
Trú tại: 136 Trưng Nữ Vương, phường Tân Thạnh, thành phố Tam Kỳ, tỉnh Quảng Nam.
- Bị đơn: bà Trần Thị Tố Thu, sinh năm: 1968.
Trú tại: 90 ALFRIEDA STREET ST ALBANS, VIC3021, AUSTRALIA.
NHẬN THẤY:
Trong đơn xin ly hôn và bản tự khai và tại phiên tòa ông Nguyển Quang Trung trình bày:
ông Trung và bà trần thị tố thu kết hôn vào ngày 3/5/1993 tại ủy ban nhân dân phường tân thạnh, thị xã Tam Kỳ, (nay là thành phố Tam Kỳ), tỉnh Quảng Nam. Hôn nhân của vợ chồng ông trên cơ sở tự nguyện. Vợ chồng hạnh phúc đến năm 2001 thì xảy ra mâu thuẩn. Nguyên nhân là do trong quá trình chung sống với nhau, do tính tình không hợp, quan điểm sống bất đồng nên cuộc sống vợ chồng luôn phát sinh mâu thuẩn. DO đó, vợ chồng không thể hàn gắn được nên bà Thu sang Australia sinh sống vào năm 2008, còn ông Trung ở Việt Nam. Nay ông xét thấy tình cảm vợ chồng không còn nữa, mục đích hôn nhân không đạt được nên ông làm đơn xin được ly hôn với bà Thu để mỗi người tự do.
Về con chung:: Vợ chồng ông Trung và bà Thu có hai con chung: Nguyễn Thị Thanh Hiền, sinh ngày 09/11/1993 và Nguyễn Thị Thanh Vi, sinh ngày 01/9/1998. Hiện nay cả hai con đang học tập và sinh sống với bà Thu tại Australia, đồng thời các con ông TRung đã lớn nên việc sống với ba hoặc mẹ do các cháu quyết định. Tại phiên tòa ông Trung cho rằng việc cấp dưỡng nuôi con, lo cho con ăn học, ông sẽ tự nguyện cấp dưỡng khi bà Thu và các cháu yêu cầu.
Về tài sản chung, nợ chung: vợ chồng ông Trung và bà Thu không có tài sản gì, không nợ ai và cũng không ai nợ vợ chồng, nên không yêu cầu tòa giải quyết.
