ĐIỀU 5: ĐIỀU KHOẢN CHUNG

- Hai bên cam kết thực hiện đầy đủ các điều khoản ghi trong hợp đồng này. Nếu có tranh chấp phát sinh hai bên cùng thương lượng giải quyết, nếu hai bên không tự giải quyết được thì một trong hai bên có thể đưa tranh chấp ra Tòa án quận 2 để giải quyết theo quy định của pháp luật.
- Khi Bên C thực hiện xong thủ tục chuyển nhượng cho Bên B và Bên A nhận đủ số tiền chuyển nhượng thì xem như hợp đồng này được thanh lý.
- Trong trường hợp phạt vi phạm hợp của bên bán và bên mua thì Bên nhận bồi thường sẽ thanh toán phí môi giới của căn hộ trên cho Bên C.
- Trong trường hợp bất khả kháng, do thay đổi chính sách thuế của cơ quan nhà nước mà không ra hợp đồng được cho Bên B thì hai bên sẽ cùng trao đổi và bàn bạc trên tinh thần hợp tác. Trong trường hợp hai bên không thỏa thuận được thì giao dịch này được hủy bỏ và toàn bộ số tiền Bên A đã nhận sẽ chuyển lại cho Bên B, Bên B sẽ trả lại căn hộ cho Bên A.
- Hợp đồng này được lập thành ba (03) bản. Bên A giữ một (01) bản, Bên B giữ một (01) bản và Bên C giữ một (01) bản có giá trị pháp lý như nhau và có hiệu lực kể từ thời điểm các bên ký kết.
