Theo quy định hiện hành, vụ mua bán sáp nhập (M&A) có vốn đầu tư nước ngoài kiểu như trên sẽ được xem xét tại uỷ ban Chứng khoán Nhà nước hoặc bộ Kế hoạch và đầu tư. Tuy nhiên, bộ Kế hoạch và đầu tư – với chức năng giám sát luật Đầu tư và luật Doanh nghiệp đã không biết đến vụ M&A này
