Bên B sẽ không được nhận lại tiền bảo lãnh thực hiện hợp đồng hoặc bên A có quyền gửi công văn đến ngân hàng phát hành bảo lãnh thực hiện hợp đồng để lấy lại số tiền bảo lãnh thực hiện hợp đồng trong trường hợp: bên B từ chối thực hiện hợp đồng đã có hiệu lực hoặc bên B đơn phương hủy ngang hợp đồng mà không có sự thống nhất của bên A. Bên A phải hoàn trả tiền bảo lãnh thực hiện hợp đồng hoặc phát công văn giải tỏa bảo lãnh thực hiện hợp đồng khi bên B đã hoàn thành các công việc theo hợp đồng và chuyển sang nghĩa vụ bảo hành.
