Theo quy định của Luật cán bộ, công chức thì cán bộ và công chức có những tiêu chí chung là: công dân Việt Nam; trong biên chế; hưởng lương từ Ngân sách nhà nước (trường hợp công chức làm việc trong bộ máy lãnh đạo, quản lý của đơn vị sự nghiệp công lập thì tiền lương được bảo đảm từ quỹ lương của đơn vị sự nghiệp công lập theo quy định của pháp luật); giữ một công vụ thường xuyên; làm việc trong công sở; được phân định theo cấp hành chính (cán bộ ở trung ương, cấp tỉnh, cấp huyện; cán bộ cấp xã; công chức ở trung ương, cấp tỉnh, cấp huyện; công chức cấp xã). Bên cạnh đó, giữa cán bộ và công chức được phân định rõ theo tiêu chí riêng, gắn với nguồn gốc hình thành.
