Các hành vi vi phạm quy định về xả nước thải được chia nhỏ mức phạt theo số lần vượt và thải lượng nước thải. Nhưng có bổ sung quy định phạt tăng thêm 1% của mức phạt tiền đối với hành vi vi phạm quy định tại Điều này đối với mỗi thông số môi trường vượt quy chuẩn kỹ thuật dưới 02 lần; 2% đối với mỗi thông số môi trường vượt quy chuẩn kỹ thuật từ 02 đến dưới 05 lần; 3% đối với mỗi thông số môi trường vượt quy chuẩn kỹ thuật từ 05 đến dưới 10 lần; 4% đối với mỗi thông số môi trường vượt quy chuẩn kỹ thuật từ 10 lần trở lên. Tổng mức phạt đối với mỗi hành vi vi phạm không quá 1.000.000.000 đồng.
Trường hợp nước thải có chứa các thông số nguy hại thì cũng được chia nhỏ mức phạt theo số lần vượt và thải lượng nước thải (theo điều 14) và cũng bổ sung thêm quy định về phạt tăng thêm giống như trên.
