Theo phản ánh của Công ty TNHH XD Nguyên Tín, trong thông báo kết quả lựa chọn nhà thầu (Công văn số 852/CV-BQL ngày 15/12/2015), Bên mời thầu (Ban quản lý dự án Đầu tư và Xây dựng huyện Hoài Nhơn) đã đưa ra hai lý do để loại Công ty này, gồm: “Giải pháp xây dựng khu vực lán trại lên trên nhà dân hiện hữu ngoài phạm vi của công trình là không hợp lý, không phù hợp với điều kiện biện pháp thi công và hiện trạng công trình” và “Biểu đồ tiến độ thi công không hợp lý vì mâu thuẫn số ngày thi công giữa biểu đồ chi tiết và cột thống kê thời gian thi công”.

Nhà thầu cho rằng, chỉ dựa vào hai lý do nêu trên mà Bên mời thầu loại Công ty khỏi cuộc thầu là “không thuyết phục và thiếu cơ sở, không bảo đảm tính cạnh tranh, công bằng, minh bạch, tiết kiệm và hiệu quả kinh tế”.

Không đồng ý với lý do thứ nhất về giải pháp xây dựng khu vực lán trại, Công ty TNHH XD Nguyên Tín cho rằng: “Vì hiện trạng của công trình là vùng ruộng trũng thấp, công việc xây dựng của công trình là đắp đất san nền với chiều cao đắp trung bình là 2m, nên không thể làm lán trại trong phạm vi công trình.
