Thủ tục mua nhà của người nước ngoà

Thủ tục mua nhà của người nước ngoài. Ngày 01/07/2015 Luật Nhà ở có hiệu lực, trong đó có quy định mở rộng đối tượng người nước ngoài được mua nhà tại Việt Nam. Trong khi chờ đợi Nghị định và Thông tư hướng dẫn cụ thể hướng dẫn chi tiết Luật ngày 30/06/2015 Bộ Xây dựng ban hành công văn số 1436/BXD- QLN thực hiện Luật Nhà ở 2014 và Luật Kinh doanh bất động sản 2014 đã có quy định một số nội dung về việc mua nhà của tổ chức nước ngoài, người nước ngoài mua nhà tại Việt Nam.

PHẦN I: TRƯỚC ĐÂY NGƯỜI NƯỚC NGOÀI SỞ HỮU NHÀ TẠI VIỆT NAM – THEO LUẬT CŨ NHƯ THẾ NÀO???

Khoản 2 Điều 65 Nghị định 71/2010/NĐ-CP ngày 23/6/2010 của Chính phủ quy định chi tiết thi hành và hướng dẫn thi hành Luật nhà ở quy định: “Tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam theo pháp luật về đầu tư thì được sở hữu nhà ở theo quy định của Luật nhà ở. Trường hợp mua nhà ở tại Việt Nam thì được sở hữu nhà ở theo quy định của Nghị Quyết 19/2008/QH12 ngày 3/6/2008 của Quốc hội về việc thí điểm cho tổ chức, cá nhân nước ngoài mua và sở hữu nhà ở tại Việt Nam…”.

Nghị Quyết 19/2008/QH12 quy định về các điều kiện để tổ chức, cá nhân nước ngoài được mua và sở hữu nhà ở , thủ tục mua nhà của người nước ngoài tại Việt Nam như sau:

1. Cá nhân nước ngoài có đầu tư trực tiếp tại Việt Nam theo quy định của pháp luật về đầu tư hoặc được doanh nghiệp đang hoạt động tại Việt Nam theo quy định của pháp luật về doanh nghiệp, bao gồm doanh nghiệp trong nước và doanh nghiệp có vốn đầu tư nước ngoài thuê giữ chức danh quản lý trong doanh nghiệp đó;

2. Cá nhân nước ngoài có công đóng góp cho Việt Nam được Chủ tịch nước tặng thưởng Huân chương, Huy chương; cá nhân nước ngoài có đóng góp đặc biệt cho Việt Nam do Thủ tướng quyết định;
3. Cá nhân nước ngoài đang làm việc trong lĩnh vực kinh tế – xã hội có trình độ đại học hoặc tương đương trở lên và người có kiến thức, kỹ năng đặc biệt mà Việt Nam có nhu cầu;

4. Cá nhân nước ngoài kết hôn với công dân Việt Nam….”.

Điều kiện để cá nhân nước ngoài được mua và sở hữu nhà: Phải là người đang sinh sống tại Việt Nam, được cơ quan nhà nước có thẩm quyền của Việt Nam cho phép cư trú tại Việt Nam từ một năm trở lên và không thuộc diện được hưởng quyền ưu đãi, miễn trừ ngoại giao, lãnh sự theo quy định của pháp luật Việt Nam”.

Foreign individuals contribution for Vietnam to be President awarded the medal; foreign individuals have a special contribution to the Vietnam decision by the Prime Minister;3. Foreign individuals working in the field of social-economic university degree or equivalent or above and who have the knowledge, special skills that Vietnam needs;4. Foreign individuals married to citizens of Vietnam. ... ".Conditions for foreign individuals are buying and owning a home: people are living in Vietnam, is the competent State agencies of Vietnam allow residence in Vietnam from a year or more and not be entitled to the privileges, immunities, foreign consulates under the provisions of the law of Vietnam ".
