Việt Nam đã có Luật ban hành văn bản quy phạm pháp luật (1996, sửa đổi bổ sung 2002) và một số văn bản khác thống nhất với yêu cầu nghĩa vụ Thành viên WTO và các cam kết của Việt Nam về tính công khai, minh bạch của pháp luật và chính sách thương mại. Việt Nam cũng ban hành Luật ban hành văn bản quy phạm pháp luật của Hội đồng nhân dân và ủy ban nhân dân để bảo đảm tốt hơn việc thực hiện nghĩa vụ thành viên trong lĩnh vực đó tại các địa phương. Pháp luật Việt Nam trong lĩnh vực này đã đáp ứng được các yêu cầu của WTO về tính minh bạch, công khai. Tuy nhiên vẫn còn rất nhiều vấn đề mà pháp luật Việt Nam cần phải điều chỉnh để đáp ứng hoàn toàn các quy định và cam kết WTO về minh bạch hóa : hoàn thiện hệ thống pháp luật đầy đủ, thống nhất, ổn định, dễ dự đoán, thực hiện hiệu quả cơ chế đăng tải công khai hệ thống pháp luật, đảm bảo minh bạch quá trình thực thi pháp luật, hoàn thiện bộ máy hành chính trong sạch, hệ thống tòa án độc lập, công bằng, đảm bảo thủ tục hành chính đơn giản, thuận tiện, quản lý hệ thống doanh nghiệp nhà nước minh bạch , rõ ràng.
