Tuy nhiên, về cơ bản phiếu lý lịch tư pháp không phải là tài liệu bắt buộc trong Hồ sơ đăng ký thành lập doanh nghiệp bởi nếu bắt buộc sẽ làm tăng thêm thời gian thành lập doanh nghiệp tạo ra gánh nặng chi phí tuân thủ rất lớn cho cả cơ quan nhà nước và doanh nghiệp, sẽ có tác động không thuận lợi cho môi trường đầu tư, kinh doanh ở nước ta.
