1. Cục Hàng không Việt Nam là cơ quan trực thuộc Bộ Giao thông vận tải, thực hiện chức năng tham mưu, giúp Bộ trưởng Bộ Giao thông vận tải quản lý nhà nước về hàng không dân dụng trong phạm vi cả nước; là Nhà chức trách hàng không theo quy định của pháp luật.

2. Cục Hàng không Việt Nam có tư cách pháp nhân, con dấu hình Quốc huy, có tài khoản riêng theo quy định của pháp luật và trụ sở tại thành phố Hà Nội
