e. Sửa chữa công trình đường bộ là các hoạt động khắc phục hư hỏng của công trình được phát hiện trong quá trình khai thác, sử dụng nhằm đảm bảo sự làm việc bình thường, an toàn của công trình đường bộ. Sửa chữa công trình đường bộ bao gồm sửa chữa định kỳ và sửa chữa đột xuất, cụ thể:
(i) Sửa chữa định kỳ công trình đường bộ là hoạt động sửa chữa được thực hiện theo kế hoạch nhằm khôi phục, cải thiện tình trạng kỹ thuật của công trình đường bộ mà bảo dưỡng thường xuyên công trình không đáp ứng được, bao gồm: sửa chữa hư hỏng; thay thế bộ phận công trình, thiết bị công trình và thiết bị công nghệ bị hư hỏng được thực hiện định kỳ theo quy định của quy trình bảo trì công trình đường bộ;
(ii) Sửa chữa đột xuất công trình đường bộ là hoạt động sửa chữa phải thực hiện bất thường khi bộ phận công trình, công trình bị hư hỏng do chịu các tác động đột xuất như mưa bão, lũ lụt, động đất, va đập, cháy nổ hoặc những tác động thiên tai đột xuất khác hoặc khi có biểu hiện có thể gây hư hỏng đột biến ảnh hưởng đến an toàn sử dụng, khai thác công trình hoặc có khả năng xảy ra sự cố dẫn tới thảm họa.
f. Sửa chữa đột xuất Công trình dự án
(i) Trong thời gian khai thác Công trình dự án, nếu xảy ra sự cố hư hỏng Công trình dự án ngoại trừ do thiên tai, lũ lụt, bão, sự kiện bất khả kháng, Doanh nghiệp dự án, Nhà đầu tư có trách nhiệm khẩn trương sửa chữa, khắc phục triệt để các khiếm khuyết, hư hỏng của công trình (nếu có) trong vòng hai mươi mốt (21) ngày kể từ ngày nhận được thông báo của Cơ quan quản lý nhà nước có thẩm quyền. Trong khoảng thời gian này, nếu Doanh nghiệp dự án, Nhà đầu tư chậm trễ trong việc tiến hành sữa chữa, khắc phục thì sẽ bị tạm dừng thu phí cho đến khi hoàn tất sữa chữa, khắc phục và không được xem xét điều chỉnh thời gian thu phí như quy định tại Quyết định số 3230/QĐ-BGTVT ngày 25/8/2014 của Bộ trưởng [Bbb] ban hành tạm thời về nâng cao trách nhiệm bảo hành công trình.
(ii) Trong thời gian khai thác Công trình dự án , nếu xảy ra sự cố hư hỏng Công trình dự án do thiên tai, lũ lụt, bão, sự kiện bất khả kháng hoặc sự cố công trình, Doanh nghiệp dự án, Nhà đầu tư phải chủ động lập phương án, khẩn trương huy động mọi lực lượng về nhân lực, thiết bị, vật tư để tổ chức phân luồng, khắc phục đảm bảo giao thông và báo cáo nhanh về cơ quan quản lý đường bộ trên địa bàn, [Bbb] để hỗ trợ, phối hợp thực hiện.
(iii) Kinh phí khắc phục được [Bbb] chấp thuận (nếu không phải lỗi của Doanh nghiệp dự án, Nhà đầu tư hoặc không phải lỗi của các tổ chức tư vấn, xây lắp xảy ra) là cơ sở xem xét điều chỉnh thời gian thu phí theo quy định của hợp đồng này trừ trường hợp kinh phí khắc phục được Cơ quan bảo hiểm chi trả.
14.3.4. Áp dụng tiêu chuẩn, quy chuẩn kỹ thuật về bảo trì công trình đường bộ
a. Công tác bảo trì đối với các công trình, hạng mục công trình, bộ phận thiết bị trong Công trình dự án được thực hiện theo các tiêu chuẩn kỹ thuật bảo dưỡng thường xuyên đường bộ, định mức bảo dưỡng thường xuyên đường bộ và các quy định hiện hành khác.
b. Công tác sửa chữa Công trình dự án phải áp dụng quy chuẩn quốc gia; áp dụng tiêu chuẩn kỹ thuật về sửa chữa công trình và các quy chuẩn, tiêu chuẩn kỹ thuật trong xây dựng công trình do cơ quan có thẩm quyền ban hành theo quy định
