ở Việt Nam, phương thức kiểm soát quyền lực nhà nước được nhắc đến nhiều nhất không phải thông qua cơ chế kiềm chế và đối trọng mà chủ yếu thông qua chức năng giám sát tối cao của cơ quan quyền lực nhà nước cao nhất, đó là Quốc hội. Nguyên tắc này đảm bảo cho nhân dân, thông qua những người đại diện của mình có thể kiểm soát toàn bộ quyền lực nhà nước một cách toàn diện, triệt để nhất. Thế nhưng, trong thực tiễn thì lại hoàn toàn khác. Hoạt động giám sát tối cao của Quốc hội còn hình thức, chưa tương xứng với vị thế cơ quan quyền lực nhà nước cao nhất. Hệ thống các cơ quan thanh tra, kiểm tra tuy khá đầy đủ nhưng chưa phát huy được vai trò của mình, khả năng phát hiện và xử lý tham nhũng, tiêu cực thấp. Các cơ quan tư pháp thiếu tính độc lập, khách quan và công bằng, chưa thực sự là cán cân công lý trong việc bảo vệ pháp luật và bảo về quyền lợi của người dân, trừng trị những kẻ tham nhũng.
