14.4.3. Lập hồ sơ quản lý hành lang đường bộ:
a. Hồ sơ quản lý hành lang đường bộ bao gồm tình trạng sử dụng đất hành lang an toàn đường bộ, các công trình ảnh hưởng đến an toàn đường bộ, an toàn giao thông; vi phạm, thời điểm vi phạm và quá trình xử lý vi phạm;
b. Hồ sơ đấu nối đường nhánh phải lập riêng để theo dõi và cập nhật bổ sung các vi phạm liên quan đến đấu nối đường nhánh để làm việc với các cấp có thẩm quyền và chính quyền địa phương nhằm đảm bảo an toàn giao thông đường bộ;
c. Không tự ý thỏa thuận cho phép tổ chức, cá nhân mở giải phân cách, xây dựng công trình, đấu nối đường ngang vào tuyến đường của dự án; sử dụng hành lang an toàn đường bộ khi chưa có sự chấp thuận của Cơ quan có thẩm quyền của Nhà nước;
d. Lập hồ sơ quản lý hệ thống hạ tầng kỹ thuật bao gồm Hồ sơ hoàn thành và các công trình hạ tầng kỹ thuật nằm trong hành lang an toàn đường bộ, giấy phép thi công và các văn bản liên quan khác.
14.4.4. Theo dõi tình hình hư hỏng công trình đường bộ; tổ chức tuần tra, kiểm tra thường xuyên, phát hiện kịp thời hư hỏng và các hành vi vi phạm kết cấu hạ tầng giao thông đường bộ, tiến hành xử lý theo thẩm quyền hoặc đề nghị Cơ quan chức năng xử lý theo quy định.
14.4.5. Kiểm tra tình trạng kỹ thuật định kỳ tháng, quý, năm; kiểm tra đột xuất sau mỗi đợt lụt, bão hoặc các tác động bất thường khác.
14.4.6. Thực hiện đếm lưu lượng, kiểu loại phương tiện cơ giới đường bộ và phối hợp kiểm soát tải trọng của phương tiện vận tải (nếu có);
14.4.7. Phân làn, phân luồng, tổ chức giao thông; thường xuyên rà soát, điều chỉnh hệ thống báo hiệu đường bộ cho phù hợp;
14.4.8. Trực đảm bảo giao thông; theo dõi tình hình thời tiết, ngập lụt, các sự cố công trình, xử lý và báo cáo theo quy định.
14.4.9. Báo cáo định kỳ, đột xuất theo quy định, báo cáo tình hình tai nạn giao thông, báo cáo số lượng đếm xe theo quy định;
14.4.10. Theo dõi, cập nhật số liệu tình hình quản lý, bảo trì công trình bảo trì.
14.5. Thời hạn và chi phí quản lý, bảo trì của Doanh nghiệp dự án

14.6. Quyền và nghĩa vụ của Nhà đầu tư đối với công tác quản lý, bảo trì Công trình dự án
14.6.1. Doanh nghiệp dự án có quyền và nghĩa vụ quản lý, bảo trì toàn bộ Công trình dự án trong thời hạn quy định bao gồm:
a. Thực hiện đầy đủ các nội dung bảo trì theo quy định tại Khoản 14.3 Hợp đồng BOT này đối với toàn bộ Công trình Dự án;
b. Thực hiện đầy đủ công tác quản lý Công trình Dự án theo quy định tại Khoản 14.4 Hợp đồng BOT này;
c. Đề nghị [Bbb] thỏa thuận chi phí sửa chữa đột xuất và các trường hợp đặc biệt khác;
d. Chấp hành việc kiểm tra, giám sát của [Bbb] đối với công tác quản lý, bảo trì đường bộ;
e. Phối hợp với Cơ quan quản lý nhà nước về đường bộ, chính quyền địa phương và các lực lượng chức năng trong công tác quản lý, bảo trì đường bộ;
f. Báo cáo tình hình quản lý, bảo trì đường bộ theo quy định pháp luật và quy định tại Hợp đồng BOT này.
14.6.2. [Bbb] có quyền và nghĩa vụ kiểm tra, giám sát công tác quản lý, bảo trì của Doanh nghiệp dự án;
a. Thỏa thuận đối với chi phí quản lý, bảo trì đường bộ, kể cả dự toán chi phí quản lý; bảo trì nếu chưa có định mức hoặc trong các trường hợp sửa chữa đột xuất và các trường hợp đặc biệt khác;
b. Phối hợp với các lực lượng chức năng, cơ quan có thẩm quyền khác của Nhà nước để thanh, kiểm tra Doanh nghiệp dự án trong việc thực hiện công tác quản lý, bảo trì đường bộ;
c. Thực hiện các quyền và nghĩa vụ khác theo quy định của pháp luật về giao thông đường bộ;
d. Tạm đình chỉ thực hiện Hợp đồng BOT, tạm đình chỉ quyền thu chí đường bộ có thời hạn đối với trường hợp Doanh nghiệp dự án không thực hiện nghĩa vụ quản lý, bảo trì làm công trình bị hư hỏng, xuống cấp không bảo đảm giao thông và an toàn giao thông khi khai thác sử dụng. Thời gian bị đình chỉ quyền thu phí được khấu trừ vào thời gian thu phí của Doanh nghiệp dự án, tổn thất kinh phí do bị đình chỉ Nhà đầu tư tự chịu.
e. Trong trường hợp Doanh nghiệp dự án có thực hiện nghĩa vụ bảo trì hàng năm nhưng không đảm bảo chất lượng thì Cơ quan nhà nước có thẩm quyền có quyền xem xét lại thời gian kinh doanh thu phí theo hướng tính toán lại Phương án tài chính trên cơ sở trừ đi chi phí duy tu, bảo dưỡng công trình hoặc thuê đơn vị bảo trì khác thực hiện công tác bảo trì công trình dự án nếu thấy cần thiết.
f. Cách trừ chi phí bảo dưỡng công trình được xác định trên cơ sở chủ trương chung của [Bbb] áp dụng cho các tuyến Quốc lộ theo định hướng sau:
(i) Tiêu chí đánh giá mức độ đạt yêu cầu của công tác bảo dưỡng thường xuyên và thời gian khắc phục tối thiểu cho mỗi lỗi vi phạm.
(ii) Xác định mức trừ tiền: Trên cơ sở tiêu chí xác định mức độ đạt yêu cầu trong công tác duy tu, bảo dưỡng, kết quả mỗi lần kiểm tra chính thức về công tác bảo trì công trình dự án sẽ được Cơ quan nhà nước có thẩm quyền ghi lại bằng biên bản. Biên bản này sẽ ghi rõ tình trạng cụ thể và vị trí những điểm không đạt yêu cầu về bảo trì công trình. Đối với mỗi trường hợp không đạt yêu cầu, Cơ quan nhà nước sẽ xác định ngày mà Nhà đầu tư phải hoàn thành các công việc cần thiết để xử lý nh
