Quy định này đồng nghĩa với việc hợp đồng mua bán nhà ở được ký kết với bên bán là doanh nghiệp kinh doanh bất động sản cũng cần phải được công chứng/chứng thực. Tuy nhiên, Điều khoản này trái với Điều 17.2 của LKDBĐS quy định rằng việc công chứng/chứng thực hợp đồng kinh doanh bất động sản sẽ tùy thuộc vào thỏa thuận của các bên, trong khi hợp đồng bất động sản ký giữa các cá nhân/hộ gia đình thì bắt buộc phải được công chứng/chứng thực.
