Khi xảy ra trường hợp bất khả kháng

Khi xảy ra trường hợp bất khả kháng, Bên bán phải kịp thời thông báo bằng văn bản cho Bên mua về sự kiện đó và nguyên nhân gây ra sự kiện. Đồng thời, Bên bán chuyển cho Bên mua giấy xác nhận về sự kiện bất khả kháng đó được cấp bởi một tổ chức có thẩm quyền hoặc phòng thương mại tại nước sở tại nơi xảy ra sự kiện bất khả kháng. Trừ khi có ý kiến của Bên mua bằng văn bản, Bên bán vẫn phải tiếp tục thực hiện các nghĩa vụ Hợp đồng của mình theo hoàn cảnh thực tế cho phép và phải tìm mọi biện pháp hợp lý để thực hiện các phần việc không bị ảnh hưởng của trường hợp bất khả kháng.

In the event of unforeseen circumstances, the seller is promptly notified in writing to the buyer of that event and the cause of the event. At the same time, the seller transfers to the buyer confirmation of unforeseen events which are issued by a competent organisation or the local Chamber of Commerce where unforeseen events occur. Unless the opinion of the purchaser in writing, the seller must still continue to perform the obligations of his contract under the actual circumstances permit and must find all reasonable measures to execute the part not affected by the case of force majeure.

When a case of force majeure, the Seller shall promptly notify the Purchaser in writing of that fact and the cause of the event. At the same time, the Seller transferred to Buyer certificates of the force majeure event which is issued by a competent organization or chamber of commerce in the country where the occurrence of a force majeure event. Unless there is a written Buyer, Seller must continue to perform his obligations under the contract for the actual circumstances allow and shall seek all reasonable measures to implement the part of not being impact of force majeure circumstances.
