2. Đối với vay vốn để thực hiện chương trình tín dụng có mục tiêu của Nhà nước:
a) Đáp ứng các điều kiện tương ứng nêu tại Điều 34 của Luật Quản lý nợ công về người vay, người phát hành và khoản vay, khoản phát hành trái phiếu quốc tế đối với các tổ chức tài chính, tín dụng;
b) Chương trình tín dụng có mục tiêu của Nhà nước do Quốc hôi, Chính phủ quyết định chủ trương đầu tư nhưng không sử dụng để cho vay thương mại.
c) Đã được Thủ tướng Chính phủ phê duyệt chủ trương cấp bảo lãnh chính phủ;
d) Khoản vay, khoản phát hành trái phiếu đề nghị cấp bảo lãnh đã đăng ký kế hoạch cấp bảo lãnh của năm kế hoạch.
đ) Các tổ chức tài chính, tín dụng phải đáp ứng tỷ lệ an toàn vốn tối thiểu và các tỷ lệ bảo đảm an toàn khác trong hoạt động của tổ chức tín dụng theo quy định của Chính phủ hoặc theo quy định của Ngân hàng Nhà nước Việt Nam, không thuộc diện bị kiểm soát đặc biệt của Ngân hàng Nhà nước Việt Nam.
