ĐỐI TƯỢNG THỰC HIỆN ĐÁNH GIÁ TÁC ĐỘNG MÔI TRƯỜNG

1. Đối tượng phải thực hiện đánh giá tác động môi trường quy định tại Phụ lục II Nghị định 18: 2015/BTNMT

Điều 10. Trách nhiệm của chủ dự án sau khi báo cáo đánh giá tác động môi trường được phê duyệt

1. Thực hiện các nội dung quy định tại Điều 16 Nghị định số 18/2015/NĐ-CP.

2. Lập kế hoạch quản lý môi trường trên cơ sở chương trình quản lý và giám sát môi trường đã đề xuất trong báo cáo đánh giá tác động môi trường được phê duyệt; trường hợp có thay đổi chương trình quản lý và giám sát môi trường thì phải cập nhật kế hoạch quản lý môi trường và gửi đến Ủy bannhân dân cấp xã theo quy định tại Khoản 3 Điều này. Hình thức trang bìa, trang phụ bìa và yêu cầu về cấu trúc, nội dung thực hiện theo mẫu tương ứng quy định tại các Phụ lục 2.9 và 2.10 Thông tư này.

3. Gửi kế hoạch quản lý môi trường đến Ủy ban nhân dân cấp xã nơi đã tham vấn ý kiến trong quá trình thực hiện đánh giá tác động môi trường để được niêm yết công khai trước khi khởi công xây dựng. Mẫu văn bản của chủ dự án gửi Ủy ban nhân dân cấp xã để niêm yết công khai kế hoạch quản lý môi trường thực hiện theo quy định tại Phụ lục 2.11 Thông tư này.

4. Thông báo kế hoạch vận hành thử nghiệm các công trình xử lý chất thải đến các tổ chức đã tiến hành tham vấn và cơ quan phê duyệt báo cáo đánh giá tác động môi trường theo mẫu quy định tại Phụ lục 2.12 Thông tư này; tổ chức vận hành thử nghiệm các công trình xử lý chất thải đồng thời với quá trình vận hành thử nghiệm dự án. Trường hợp gây ra sự cố môi trường thì phải dừng ngay hoạt động vận hành thử nghiệm và báo cáo kịp thời tới cơ quan quản lý nhà nước có thẩm quyền để hướng dẫn giải quyết; chịu trách nhiệm khắc phục sự cố môi trường, bồi thường thiệt hại theo quy định của pháp luật.

5. Trường hợp khu kinh tế, khu công nghiệp, khu chế xuất, khu công nghệ cao, cụm công nghiệp, khu kinh doanh, dịch vụ tập trung tiếp nhận dự án đầu tư không phù hợp ngành nghề thu hút đầu tư trong báo cáo đánh giá tác động môi trường đã được phê duyệt của dự án xây dựng cơ sở hạ tầng nhưng chưa đến mức phải lập lại báo cáo đánh giá tác động môi trường quy định tại điểm c Khoản 1 Điều 15 Nghị định số 18/2015/NĐ-CP, chủ đầu tư dự án xây dựng cơ sở hạ tầng phải có văn bản giải trình gửi cơ quan đã phê duyệt báo cáo đánh giá tác động môi trường và chỉ thực hiện các thủ tục tiếp nhận đầu tư sau khi có ý kiến chấp thuận bằng văn bản của cơ quan đã phê duyệt báo cáo đánh giá tác động môi trường.

6. Trường hợp có thay đổi chủ dự án, chủ dự án mới có trách nhiệm tiếp tục thực hiện báo cáo đánh giá tác động môi trường đã phê duyệt.
